  • Hi everyone, newbie! Desprately in need of help, payday loan comp cleared account out

    Hi everyone, I am new to here & would gratefully appreciate any advice you could offer. I have a payday loan with cheque centre, I unfortunately realised I was unable to pay back the full amount in January as had got in over my head. I went into the branch & the girl advd I could pay back at £112 pcm, I accepted this & unfortunately , come February when the 1st payment was due, thanks to everything not being paid the previous month, I was unable to make the payment as I had double car ins etc coming out. I called them to advise & they asked me to provide a bank statement to show hardship, which I did. They called me 5-6 times on my mobile & I kept missing the call & had no credit on my phone to call them back & did not want to phone from my work & risk overhearing. I was paid on Monday afternoon & so called to pay them a payment & set up a more realistic & affordable payment plan yest afternoon. I have been devastated to find out that they have taken £767 out of the £777 that was in my account. I am honestly close to breaking point! this is all the money I have to keep me & 3 children all month, I didn't even get a chance to get any food in for the kids or get petrol. I am also in a relationship that I am currently trying to get out of after 14yrs of dealing with his alcoholism but cannot afford to move out yet but we physically & financially lead separate lives & because we technically still live together, I cannot claim child/working tax credits, so this is all the money I have. I am at my wits end & don't know where to turn. The ironic part is that I managed to get back to work after being off for 3 years being newly diagnosed with multiple sclerosis. I was in receipt of DLA including a mobility car which is why I felt I could get back to work, in doing so, they took my DLA back off me (inc my car) & I am now £380 pcm worse off for working?!?!?! sorry for the long post but don't know where else to turn.

        You must contact them immediately, tell them that the amount taken has put you in extreme hardship an that you will not be able to feed your children, tell them that they must refund at least £xxx and allow you to start an equitable payment plan. Contact them via e-mail and by phone.

          Had they already taken the money out of your account at this time?

          Why did they take your car off you since DLA is not means tested?

          Are you getting bank charges as well?

          Was the double car insurance an error on the insurers part?

            Entitlement to motorbility is dependent on the person being eligible to the higher rate of mobility component on the DLA award, if the claimants physical condition is not severe enough to fall into this category the benefit and the entitlement is removed.

              So would the fact that they decided to return to work, go against them or would they have been assessed beforehand?

              Just seems odd that it would simply be taken off them because they found employment cos that offers no incentive to find work.

                A return to work does not mean the cessation of DLA,,If the OP's health has got a lot better then Yes,DLA will change/stop.

                  DLA is supposed to be a benefit that enables people with disabilities to get the support they need to lead as normal a life as possible and it is neither taxed nor means-tested. The fact that the OP used the support to return to work is exactly what this benefit is intended to be about.

                  As usual in the lala land of benefits. if you are honest it counts against you - ie any change in circs needs to be reported and if you get some nitwit flagging it up as an "improvement in condition" whereas it's just a legitimate use of the benefit.....

                  If this is what's happened then the OP needs to appeal - but that's in the longer term; for now - if it were me I would take GT's advice.

                    There are certain physical requirements for the higher rate to apply. This is all under revue, and the criteria is going to be made even more difficult when PIP takes over from the dla later this year.

                    Eligibility for PIP

                    The Department for Work and Pensions (DWP) will award PIP based upon their assessment of an individual’s ability to carry out a range of everyday activities. Regulations to finalise the assessment criteria for PIP will not go before Parliament until early 2013. The eligibility criteria for PIP will be different from those for DLA today and existing DLA recipients will not be automatically transferred across to PIP. This means that even if you already receive DLA, you will need to make a claim for the new benefit when the DWP invite you to do so at some point between 2013 and 2018. The DWP will then assess your claim and decide what level of PIP benefit you should receive"

                    It has been forecast that many current holders of the entitlement will fail the new test and as a result loose their vehicles, one of the tests will be that the applicant must be unable to walk 50 yards unaided.

                      It also needs to be said that everyone has good days and bad days - the more so perhaps with a disability - and often the bad days are unpredictable. Any dealings with the "decisions makers" in the DWP need to be based on worst case scenarios - honest but based on the bad (worst) days. Any attempt to look on the bright side (as is normal practice to retain sanity) will likely lead to loss of the benefit

                        I could spout on endlessly about MS/DLA entitlement but that won't help the PDL crisis but if,when things are sorted for you with the PDL,raggydoll,you would like to chat about it,pop on this thread and we can discuss it (with everyone else)..I have primary progressive MS so might be able to point you in the right directions x
