    i am taking particular interest in the anticts of payday loan companies.
    yesterday i had £30 taken from my bank from a payday loan company i used 2 years ago.
    after ramming down the throat the relevant statutory requirements to the bank drone

    The Payment Services Regulations 2009
    Payment service provider’s liability for unauthorised payment transactions

    61. Subject to regulations 59 and 60, where an executed payment transaction was not authorised in accordance with regulation 55, the payment service provider must immediately—
    (a)refund the amount of the unauthorised payment transaction to the payer; and

    (b)where applicable, restore the debited payment account to the state it would have been in had the unauthorised payment transaction not taken place

    THE MONEY WAS REFUNDED

    HE TRIED EVERYTHING TO AVOID THE REFUND, THEY MUST HAVE A SCRIPT

    now my question has to be is how they managed to debit a card that was replaced 18 months ago

    i am told it is only the first 12 numbers on the card that are changed, the last 4 that links it to your account do not, it is the last 4 numbers that they use

    the only way i can think of stopping this would be a brand new account number or sort code

    comments please people as this thread will be used to help other less fortunate people in my position who find it hard to stand up for their rights

    Yes if payment was promised the bank has a duty to honor it.

    Mistakes can occur, this is why the regulations you quoted were introduced.

      but the statutory regulations take precedence

      if it is reported as an unauthorised transaction

      the bank must replace the debit

      as stated

      a banks t&c do not override statute provision

        Not really sure what you mean, if the bank has paid erroneously then they must replace the funds(obviously).

        The bank will not know if the payment has been wrongly made until it is reported, you would be the first to complain if the bank did not honor a legitimate request(as would I) how are they to know the difference?

        This has been a long standing problem with debit cards, a hang over from when transactions took days instead of seconds, hopefully the new regs have solved the problem

          My mother in law is having a similar problem with a payday loan company and people on here have advised us to tell the bank to cancel any authority for and recurring card payments from them and to also tell the payday loan company the same thing that she is removing any authority for them to keep taking the money I havengot a thread on here that does state the regulations on it incase the bank tries to say no they can't cancel it etc

                Yes I will do were trying to get hold of her reference number St the min as it doesn't show on her online statement so I'm waiting for her to ring them to find it out I have the letter all typed ready to send off to CEO of Wonga once we have this
