    I am not to sure if being honest of exactly what i have paid as i did pay these rollover loans for many months to so they have already had a good bit of money off me.

      Yes this is how they work unfortunately.

      The only way to get out from under is to draw a line in the sand and say no more.

      Ir may come to the point where you say, either accept this or take me to court, but wait and see what the say to the offers first.

        Yeah it sounds like best idea, i was just trying to get as much advice as possible and anyone who has had this experience to let me know how they handled it..
        I will be sending me emails to them today, they are typed and ready to go- hopefully they will accept and i can get them off my back. Failing that court and a pound a month will have to do them at present.

          There is a way to go before court action.
          I have dealt with a number of these, and all i can tell you is that there is no one size fits all solution.
          They do not like to go to court it must be said unless they think that hey are going to get a default judgment, if they reject the offers the next step is to request a detailed account summary.

              Usually they won't go to court because they know they will lose. Sadly, many people who have to take out these loans will allow a default judgment to be made.

              Can someone remind me (davyb!!! lol) if these companies report to the CRA's?

                Obviously don't give them any debit card details.

                Yes they can mark the file but it s possible to challenge the entry, depends on what they have put.

                They seem to be avoiding the phrase full and final settlement

                The ideal situation would be to send them a letter back saying that the payment would be being made directly to them from the family member on your behalf, you would need confirmation that this would be a full and final settlement on the account, and it would be much more convenient if you could have their bank details.

                Also the maximum you able to offer in full and final settlement is £350. Confirm that you would not wish to be using their firm at any future date.

                I think it may be as well to add that if this is not acceptable you will require a full statement of account showing all tansactions since the inception of the loan, in order to verify the sum claimed.

                        I would reply as per post 37.

                        Dear sir in response to your correspondence dated********

                        I am only able to offer £350 as a full and final settlement on this account, as this is a one off payment it would make sense to transfer the payment directly into your account. The payment will be made from my family members account on my behalf.

                        If this is acceptable please confirm, if it is not please send a statement of account sowing all activity on the account since inception in order for me to verify the amount claimed.

                        I repeat i am unable to offer any more than stated and if this is unacceptable your only option is to commence court proceedings, if this is your Choice i again request a statement under pre action protocol procedure.

                        Please understand this is just my opinion you may not want to do this, if you want to pursue a different path i will help you with that.

                        They are unlikely to litigate, they usually pass their debts to Mackenzie Hall(DCA).
                        If they do, the response is simply that you offered a full and final ir was refused so please take me to court and see if you can get some more. As i say this is my view others may think differently.

                          I should explain why it is important that the payment is not made directly by you(if it can be avoided).
                          If the payment is a full and final settlement and is made by a third party, it is difficult for the creditor to pursue any further payment as a new contract will be formed.

                              Its entirely up to you, do you want to stick to your original offer or are you willing to go up to £500?

                              If you are willing to go up I would advise saying.
                              I would like to accept your offer of £500 as full and final offer on the above account.
                              Since this will be a one off payment i do not see any reason for giving my account details and will ask my family member to pay the sum directly into your account, please let me have details and confirm that this is acceptable as full and final settlement of the account. I will then process the payment forthwith.

                                No my original offer to QQ was £500

                                The £350 was to TXT loan, but i have not heard from them yet, sorry for any confusion.

                                Also have you had this problem yourself do you no many people who's offers have been accepted, thanks for the help at the min, i will let you know what they come back with
