  • Barclays Bank Chasing Loan

    Need some advice please.

    Back in early 2017 my ex husband took a loan out in my mums name. He applied while mum came to stay with me for about 6 weeks while she recovered from an operation. I knew nothing about this loan as did my mum and he applied under her address and went and collected her post from her house .Obviously the loan confirmation documents will have been what he collected. It was only when we split up in late 2017 that he stopped paying the loan that this all came to light. I explained to Barclays the situation but they didn't believe it was fraud and it ended up going to PRA Group . Back in 2023 I got an email from PRA Group after telling them the issues that they were no longer going to pursue the debt and would remove the defaults from mums credit report. Mum has today received a letter from Barclays asking her about her intentions to repay. As this has been over 6 years and we have never acknowledged she owes this money or made any payments, can we assume this is now statue barred? And if so are there any template letters I can send Barclays to this effect?

    Was the matter reported to the police?

    I don't think you need to use a template, just explain that the debt was disputed on XX/XX/XX.
    They have been informed that a fraud had taken place. You were sent confirmation by email
    that, that it was the end of the matter. If you have the email, send a copy with the letter.
    You could send a SAR to obtain a copy of the email if you don't have it.

    It maybe statute barred, the problem with stating 'statute barred' is that you are saying that the
    account was taken out fraudulently and you didn't set up the account.
