    there is another case with Abbey that is being looked at in view of the new terms of waiver - so I suggest you do another letter to Ronan who I think dealt with Simons case



    I refer to the above case.

    I am sure you are aware that the new terms of the waiver have been issued.

    I am therefore asking you again to review my case as I was at the time of the charges suffering severe financial difficulty and am still on a reduced income now due to the loan I had to take out for my day to day expenses as all my benefits were taken in charges


    In making an assessment of financial difficulty the firm will take into account:
    a.
    evidence of changes in lifestyle, including loss of employment; disability; serious illness; imprisonment; relationship breakdown; death of a partner; starting a lower paid job; parental/carer leave; and starting full-time education;

    this section applies to me as we were suffering from illness and loosing our house and a reduction in income




    evidence of the following events:
    i.

    items repeatedly being returned unpaid due to lack of available funds;


    Please see my enclosed spread sheet for evidence
    ii.
    failing to make loan repayments or other commitments;
    iii.
    discontinuation of regular credits;
    iv.
    notification of some form of insolvency or court proceedings;
    v.
    regular requests for increased borrowing or repeated rescheduling of debts;

    We had to take out loans for basics such as food - see my previous letters
    vi.
    making frequent cash withdrawals on a credit card at a non-promotional rate of interest; and
    vii.
    repeatedly exceeding a credit card or overdraft limit without agreement (and, in this regard, where a complainant has incurred over £500 in unauthorised overdraft charges in the previous 12 months, that is to be treated as indicative of financial difficulty). Some threads to read:

    Fill in some details as per my example

    Keep it simple and factual

    Send a copy to FOS

    Do the letter ASAP

    Draft for us to look at . Use dates if you can - eg on XXXX you charged me XXXX for one failed cheque

    on XXXX i was forced to take out a loan of XXXX as I had no money to live on

        been working on this and the charges from 12th jan-11th june 07 are not included in the charges i shall post the charges for u to see
        also in april they well i will type it for you

          (b) My husband being made retired under ill health, leading him to be on incapacity benefit siatica of the spine and hip pain which affects his leg pains.

          (d) Items repeatedly being returned unpaid due to lack of available funds:
          January 12th 2007 up till 11th june 2007, in which you will see on my statements and the originals you have that the charges for cheque number 001321 £250
          The charges in feb, marxch april may june were charges
          O/D charges clearence fees
          Charges for returned cheque interest charges
          All continued from jan 07 to 11th june 07, these charges ARE NOT INCLUDED IN THE CHARGES that district judge bryce ordered on his order in blackpool court on 8th january 2008.
          You have this on file but I shall enclose it with my correspondence.

          April had continued charges as follows

          We had court proccedings as we didn’t want to loose our home but through all the problems with charges we couldn’t get the mortgage payments together espically when you took charges from my benefits and left me £1 to live on for a fortnight see your files you already have with all the confirmation you already have.

          Upon speaking with a advisior at a branch of abbey on the phone he did see on his computor that the charges I was speaking about he said that this should not have happened and continued all the months if you have the tape do please listen to the conversation. Dated advisors name

          I had to take out loans to manage to get food - see my previous and hardship letter that was sent to yourselves and to FOS. On your file.

          This is to be treated as indicative of financial difficulty.

          My total charges £3117.02 plus intrest as ordered and corrected by District Judge Bryce 08/01/2008 at Blackpool county court .

          All documentation you do have on file and Sandra Greene at FOS,

I don't understand this part either - have you had some charges returned? no this the total amount of charges as stated above for the same cheque but i have not add these on to the charges being reclaimed as they took me to 3/4 debt recoveries and i telepjhone them and told them that i do not owe this and explained that they are repeated charges for the one cheque

Again, did you lose your house? yes we klost our home and had to sell and rent it back as we didnt want to loose our home and this was the only way around it to keep our home

              Upon speaking with an adviser at The Abbey on the telephone I was advised that the charges should not have occurred because, (what reasons did he give you?). he didnt he just apolygised and said that abbey were wrong for chargeing me the same charges for the one cheque they should have only charged me once not 5 months feb march april may up to 11th june 07

              My total charges £3117.02 plus interest as ordered and corrected by District Judge Bryce 08/01/2008 at Blackpool county court. What does this part mean? i went to court 8th jan 2008, and DJ Bryce put it on his order the total charges with interest i am trying to reclaim from abbey as the judge wanted to lift the stay on my case and he told me that he phoned abbey to have the stay lifted but abbey told judge bryce that they would appeal against it with the oft test case starting on the 14th judge bryce also said he had read my claim/case in detail and felt for me that he then turned to abbeys rep and told her that he blames abbey for my situation so he ordered that it is recoreded that that the value of the calim is £3,117.02 with interest.

              All documentation you do have on file and Sandra Greene at FOS, (what about Sandra Greene, does she have your information too?).yes everything i have sent to abbey is with sandra greene the adjustication (spelt wrong sorry) officer at FOS as the fos said i have a case and was referred to case worker) it is all here in this thread ty
