lol - I just meant having a salary as well as the benefits makes the hardship case less cut and dried.... and it would have to be mentioned in the lift application where we talk about income.....wasnt suggesting you were dodgy... sorry if it sounded that way hun.

Hi I do receive my wages legally as that is how I get working tax credit so there is nothing underhand going on.

Sounds like you might have a good case kim.
If you could send me some details by pm or by email amethyst@legalbeagles.info - I would like to see your original application to lift the stay and any letters you sent with it...and the letter from the court ordering the stay, and ordering the hearing to dicuss the stay lift application. Also need details of amounts on your income, and debts you have, mortgage arrears (are you threatened with reposession etc - how much arrears etc), council tax that kind of thing.
Also a bit of history - when you started using that account solely for benefits etc.
The 10k cash you earn could be tricky and you would have to mention it in the forms, but as that account is solely your benefits I think you might have a case to argue for inalienability and hardship.
We should be able to write a nice witness statement for you to use in court with all your arguments and back up information on.

What would you like to know? I have paid over 13k incharges in the last 6 years. I have struggled to pay these charges ie bank returning mortgage DD and getting into arrears I have borrowed off my friends which I still owe them and hope to repay once these charges are sorted.

We can help you with applications to lift stays, but we really need a lot more info. In short, the only cases where you stand a real chance of lifting a stay is where the hardship grounds are extreme.
Please give us a much fuller picture so we can advise.
