  • Not her debt but agency threatening court action

My elderly aunt is continually being harassed by a company called Oriel on behalf of Ova Energy. The debt is not hers. A property she owned was let to a tenant who left without paying her bills and is now living in the USA. My Aunt has no address for her. She wished she did because the tenant did a lot of damage to the property. Despite contacting Oriel in writing 11 times and also the debt company before them , they continue to ignore her letters and send threatening letters to her which is most distressing. She has explained the situation to them in writing and knows they have received the letters but still they ignore her and are threatening court action. My aunt is 89 and not in good health. I have tried to speak to Oriel on the phone but they ignore me. My aunt is deaf and only communicates to companies in writing. I have also written to them on her behalf but still they ignore our letters and she receives the same letter back from
them over and over again. Really don’t know what to do. Any advice would be appreciated .

Write a Formal Letter of Complaint, explain what's happened, explain that you've communicated with Oriel - that they have ignored the communications and explain what you want them to do. Explain that your aunt is elderly and this is causing her distress. Send a copy of the letter to the FCA and CSA.

If you have a copy of the AST / any proof of date they left then send a photocopy with the letter - this is proof they cannot ignore

Is it possible that notwithstanding the letting of the property, the account in question remained in your aunt's name?

If there is a full name, possibly a state too, then most people are traceable, not too difficult these days.

Even if it was possible to identify with certainty the previous tenant OP's elderly aunt would find very difficult to enforce recovery from the tenant in the US courts, especially if (as seems likely) the person she tries to contact simply ignores her.

Thanks everyone. This is useful. And no the account has never been in my aunts name. It has always been in the current tenants names.
