    It needs to be submitted to your bank with all the paperwork around this bit. I think the question I would ask as well is whether we can delay the repossession while the bank looks at the hardship issue.

      I am not sure that GMAC would be interested in hardship claims as they do not come under the FSA waiver rules for hardship on bank charges.

      They are supposed to be sympathtic, but rarely they are.

      Can you if you have not already started a thread in the mortgage section do so all stating all the details surrounding your current crisis, ie how many months in arrears, how much is the arrears, have you tried to spread the arrears and made an offer, what was the cause of the arrears ..... we need much more info to be able to help.

      What date is your hearing are you sure it is a repo or is it a suspended repo....

      Can you now afford the monthly payments + additional each month to pay the arrears! Have you completed an income and expenses summary http://www.legalbeagles.info/forums/...ead.php?t=5102 as you would need to deal with this in any negotiations or the courts.
