      sent an e-mail today so will await a reply am i right in thinking the bank has 8 wks to say yeh or ney to my hardship status? I am sure i sent the forms off more than 8 wks ago and will take this up with the FOS.

        I think that 8 weeks would run from your original complaint - but did they put a time limit when they replied to your recent correspondence?

          thank you for that and not that i know of. Because originally my hardship claim was rejected as they did not have enough information from me i got them to re-open it with the help from the FOS and so now i am not sure what the time frame is if any?
          *Would be very helpful to have a time frame other wise they could continue for as long as a piece of string i feel.*
          The reply that i got from the FOS today was still waiting for the banks response regarding my hardship status i believe if it is positive then i will get my charges refunded but if they come up with something as a way of a fob off then the FOS will have to decide the way forward.
          I just dont know how long all this is going to take and i will keep putting pressure on them to sort it out ASAP but all i can do is call, e-mail etc i just feel so helpless with all this right now as it seems there is nothing i can do i have done everything possible to help things along.
          I think one thing that does worry me is if they say that RH (bank charges company)are dealing with my case so there is nothing they can do and i beleive that they will try any tact to get out of paying me. If they do this then i can cancel my contract with RH asap and then they will have no excuse so maybe this will go in my favour.
          Still playing the waiting game until i hear any more news from the FOS.

            in some ways I would expect you to keep pushing - after all the whole point is that you need some help now.

            Did you find the original agreement from RH ? What was the last correspondence from them? Are they not doing anything at all ?

              good morning everyone the day has come when i have finally had an offer from the bank happy days :beagle:
              The only thing is the amount is for £5,995 and my claim is for at least 8k so although i am over the moon but i dont want to sign that it is in full and final settlement am i right in thinking that they cannot do this as it says in the hardship waiver.

              my question is if i dont accept this payment will it delay me getting a payment or do i write to them and say i will accept as an interim payment until the test case is complete.

              please help as i really need this money to sort out my mortgage arrears etc before i get repossessed i dont want to hold things up but i am soooo happy at the same time.

                    On the top line line next to the smiley is a paperclip, click on that and find your file and click ok to upload it.

                      I have e-mailed Amy with my letter and she will post it up and i await your advice.
                      I cant believe that they want me to sign this in full and final settlement though. Surely this goes against the hardship rules and regs?
                      I have waited so long for and they do owe me the interest plus the balance so i am going to fight it out all the way to be honest.

                        Jules, please can you let us know the exact amount that you consider Halifax owe you in charges, on your thread you have mentioned various figures, 20K, 15K and now 8K. Just so that we know exactly how the offer compares with your total claim.

                              lol yes i am sorry bout that i did get a bit confused in my threads i believe the actual figure they owe me is approx 8k as the offer they are giving me is from my original claim way back in feb 07 there have been charges since then so i think that is where the confusion may be with this offer.
                              But having said that i dont know if that would be including interest.
                              I really need to sit down and work out exactly how much in charges plus the interest dont i? i dont have time to do it now as i have an interview at 3pm today but i will do this evening.
                              I will have to go through bank statements from jan 07 to present day to work it out pheww
