      hi i just thought i would ring the FOS today and see how long it would take for me to get assigned a case worker and suprise suprise they said it would take about 6 mnths. That was until i mentioned the waiver the girl on the phone sounded about 16yrs old and did not know a thing so insisted that she put me through to someone who knew what i was talking obout, that was about half an hour after i kept on insisting.
      Anyway she put me through to someone who seemed to know more about the waiver etc and he said he would get someone to call me as a matter of urgency.
      I though yeah rite.
      but to my suprise someone rang me and told me he was on my case well as from now and would be contacting the bank to see what they were going to do about my bank charges claim.
      i feel though if i had not rang up and insisted about the waiver they would have given me the same fob of like sorry nothing we can do until the test case has been resolved. I wonder how many people they get rid of like that thats why it is so brill to have this site where you get the most up to date info and you know what is going on and the right things to say to these people.
      The FOS guy i spoke to was brill though and said i had a good case for hardship as i explained my circumstances so hopefully should hear soon. He did say if things deteriate or he has not heard from him for a while to contact him again so thats nice huh.

        i have known cases where one call from the FOS did the trick . So fingers crossed!

          hi folks hope everyone is having a good week.

          The bank HBOS have not got back to me yet i think they have another month to do so i am going to ring them tomorrow to see what is happening with things as they have to send me forms etc i believe so waiting on that.
          Still in contact with my case worker so he knows my situation.
          Also still waiting for my SAR request from lloyds tsb (who are buying HBOS out i believe) but that is not as urgent as HBOS but still needs to be addressed all the same.

          All quiet on the western front regarding bailiffs and clampers at the mo.

          Have started new job which is long hours from 10 am to 8pm but pays quite well so sticking at it.

          I have joined my local credit union and will be transferring all my money to them asap so hopefully no more bank charges.

          As soon as i hear from the bank i hope things will move swiftly to my getting a settlement out of court. Fingers crossed.

            just an update on my case. I still have not heard from Halifax which is annoying. i rang them and they said someone would get back to me which they havent so i will be ringing them again on Monday the person i spoke to said it sounds quite urgent because of the fact i have mortgage arrears and council tax arrears but nothing official yet.
            watch this space!

                Jules, good luck and hope you have some news next week.

                Halifax agreed my hardship and awarded me 100% of one charge - all the rest were over 6 years and now I will be going to court - it should be very interesting.

                    Hi Jules,

                    I had only one charge of £28 that fell in the six year peiod. All the rest of my claim were over 6 years and up to 18 years old 1990.

                    So they agreed 100% of that £28 charge - but did not offer any interest.

                    As I said it should be interesting.

                      update after a few phone calls i have finally got through to someone they have resent me forms as it appears i was not classed as a hardship case when i last filled them in July. I have told them my circumstances have changed considerably since July and could they re-look at my case which they have agreed to do. Finally getting through and looks like they will decide within next couple of weeks wether they consider me as a hardship case and if so refund me the charges.
                      Also had a reply from Lloyds tsb regarding bank charges for last 6 yrs they have sent me a list of charges which comes to approx £1.5k so am going to send them a letter asking to refund the charges and then probably receive standard reply then i will send a letter asking them to consider me under hardship case and see how it goes. As i owe them money eg a loan and overdraft they will prob just take this off of amount owing i rekon, which would be better than nothing.

                        Hi Jules, well done on getting the hardship issues looked at again by Halifax, fingers crossed.

                        As for your letter to Lloyds, I would combine the two letters into one, dispute the charges (remember the Penalty Charges aspect with Lloyds charges is still not decided) and also include within that request for repayment details of your hardship and the FSA waiver as you have with Halifax. There is no need to send two letters with a gap, combine the two and explain your circumstances.

                                hi quick update i am still waiting for the bank to contact my case worker at FOS he is great by the way and always replys promptly to my e-mails and answers his phone OMG every time. lol
                                his name is David Eynon his e-mail is (david.eynon@financial-ombudsman.org.uk) I recommend anyone to contact him if they are having problems with bank getting hardship status.

                                Anyway i am still playing the waiting game i may contact him tommorrow to say my circumstances are worse as he said to do so if things got worse.

                                would be so nice to get this sorted before xmas.

                                anyone got any advice or do i have to just wait?:beagle:
