12 years old council tax debt

  • 12 years old council tax debt

    I have received a council tax letter with only my first name on it .And two of the others names I do not know. The debt is about 600 pounds,and it charged for 12 years ago.I have never lived at that address.I have called the council and said that was not me,they asked my name and said they going to change the name on the letter. In this case, where do I stand?what should I do?

    Write to them and say that you have never lived at that address, you do not know the other people named and that they have sent the letter to the wrong person.

      I'd imagine that the local authority have tried to trace the debtor and come up with your address. You need to contact them and advise you were not resident at that property - if you can tell them where you were resident then it would do no harm. The council should be able to conform where (and how) they found your address.

        I may be wrong, but 12 years could be outside the Satute of Limitations.

            12 years relates to Morgages?

            However, it is unlikely that the council will allow Council Tax arrears to remain unpaid for more than 6 years. There is no time limit for recovery of HMRC debts such as tax or VAT owed and any related interest. As such these debts cannot be StatuteBarred.

                Has a liability order been issued years ago?

                A liability order is a court order - the council applies for them in the magistrate's court and they are generally awarded as a matter of course (there are very few defences so people rarely defend themselves).


                There's no expiry on the order so if they want to pursue you for it they can, even after 9 years, and they're allowed to use bailiffs to boot.

                      To get this right as long as the Council apply for and obtain a Liability Order within 6 years of either it becoming due or becoming aware then there is no time limit on them chasing for the monies owed & yes they can put it out for enforcement by Bailiffs if required.

                        So, since April have you tried to chase it further to establish the details of when and where the monies are for ? If you haven't then I certainly wouldn't advise waiting 2 months to do so.
