Hi guys
Through social media I was made aware that there were bailiffs at my previous address, I did some digging and found that this was because I have a 7 month old ccj against me. I managed to retrieve my letters from the previous address and this ccj was a default judgement. I immediately emailed bw legal to ask them to consent to set aside the judgement and work something out. I have had no response. So my questions are

how do i ask the court for this?

Can i dispute the amount I owe on the grounds they put my credit limit up with out notifying or asking even when at the time i had numerous problems with payday loan companies and low income? (irresponsible lending)

How likely is it that they will set aside the judgement? Considering I have just found out about it.

Apologies in advance if this has already come up on here I looked for a while and couldnt see a suitable thread

Desperate for help as this is going to set back my credit rating another 5 and a bit years!

Hi Scotty1902 & welcome to LB.

The judgment creditor is not likely to be BW Legal.
The request for set-aside consent should be addressed to whoever obtained the CCJ.
You should have that info in the letters sent to your previous address.
If bailiffs are sniffing around it may be wise to consider a set-aside without consent.

Ok, the judgement for claimant form I received from the court lists the claimant as lowell portfolio and name and address for payment as bw legal.

So what you're saying is Lowell is who I should ask for consent to set aside?

I contacted them first and they instructed me to speak to bw legal. I called bw legal and asked for consent and they said they cant the woman even put me on hold whilst she double checked. She did say can't and not won't.

Should I go back to lowell?

Given the urgency, if it were me I would email Lowell's ceo to ask for consent & request that bailiff action is frozen while this is sorted. Mark email 'urgent' in subject box & put Lowell Portfolio 1 v Scotty1902 Court Claim No. XXXXXXXX.

Ask for an urgent reply.
Follow it up with phone calls. 0345 300 9410

I'd also make sure that my vehicle was out of sight of predatory enforcement agents.
If they do visit, do not let them in.

There isnt an email address for the director just a list of names. The warrant has been out since 01/11/16. Not sure what to do next now. Should I try calling lowell customer line?

I continued looking and found an email I think might work so they've had a email from me asking to set aside the ccj and freeze bailiff action. Fingers crossed.

There isnt an email address for the director just a list of names. The warrant has been out since 01/11/16. Not sure what to do next now. Should I try calling lowell customer line?

After writing to the director, Lowell responded by saying saying BW legal is managing this on their behalf, BW said they cant make the decision.

Who can consent to setting the judgement aside. So confused!

The director I contacted before I heard from you was James Cornell and the response was sent from Lowell complaints.

I forwarded the email from lowell to BW so they cant see that lowell is stating its their responsibility.

This is awful, all I need is a yes or no on consent so I cant contact the court.

Andrew Bartle the Chief Operating Officer of the Lowell group he's a bit more hands on then Cornell.
