    Hi, wasnt sure if this was in the correct place so have posted here, sorry if wrong, I had originally put in payday loans but its also DCA so didn't know. Thanks
    Hi Everyone,

    Today my partner received a letter from asset collections, basically saying they will be going for a CCJ in 10 days if they don't hear from him. They wrote back in early August but I telephoned and said he didn't live here. Then this today, I suspect that's to do with him getting a new (second hand) car recently and registering it here and also insuring it - although he paid the insurance in one go I think they still did a credit check.

    This is for multiple loans with Lending Stream (They were taken out at the same time and rolled over, not sure if this is relevant)

    I'm not sure what to do, basically I took the loans out a few years ago when we had bad money problems and he has no idea. Very stupid I know but I was trying to save us and save my relationship I did some pretty stupid things and now they are all catching up (we moved into my parents house a year ago and I'm now starting to dread the phone go and the postman coming like I used to, also got a letter from Lowell today - are those two connected?

    Do I have options or am I going to have to sort out a payment plan? He/I/We owe them just over £2000.

    Good morning,
    How much is being claimed?

    What does Lowell's letter say please? Is it telling you that an account has been assigned to them or is just a tracing letter.

      Hi, the lowells letter says he still hasn't made contact. And to contact them to set up a payment plan. It's a jd williams account and is claiming £200. Jd williams were invoicing for £70 worth of goods which were not recieved which is why I stopped paying and left £70 owing, disputing this. I think the rest of the £200 is charges. Just before we moved lowells sent an offer of £70 to clear the debt. So this one isn't too much of an issues I will either try my luck disputing again or offer them a full and final of £70.

      To be honest it's not lowells that's bothering me. I just thought it odd getting noth letters on the same day, perhaps it's just a coincidence.

      The one bothering me hugely is asset collections. As they have sent the letter before legal action ... I don't know if I have options or if I'm going to have to set up a payment plan. I would estimate lending stream lent out close to £6000 and most of it was paid back. Asset collections have said he owes just over £2000. Most of the loans were taken out along side each other and were also rolled over etc. I previously told asset collections he didn't live here but I'm thinking the car business has set them off again and I can no longer say he's not living here?

        Can anybody help me with this at all? Sorry its just I need to reply to them today/tomorrow or I guess they will go for a CCJ. Should I try and set up a payment plan?

          Hi,

          By way of response to Lowell send a request for a copy of the agreement relevant to the account with JDW (CCA Request) there's a template in the green box at the top of the " court claim forum page.

          There is a £1 statutory fee to pay. Use a postal order marked " For Statutory Fee Only" and use signed for post.

          Lowell has 12 + 2 Working Days to comply.
          Further action would be to inform Lowell that the alleged debt was in dispute with the original creditor and you cannot reconcile the amount claimed and no liability to Lowell is acknowledged.

              Should I be sending any letters to asset collections? I'm really quite worried this will turn into a ccj.
