  • Bailiffs rights

I've had a bailiff contact me in regards to my son who used my address as postal address and now they have threaten to put my door in to collect goods !! My son has never lived at my address or been registered here. I explained this and the fact I live in a fully furnished rented property but this bailiff has been very rude in reply where do I stand as he said he want to come in and look around to see if my son live with me ???? Where do I stand

Don't let them in and if you have a car lock it in the garage or,store it a few streets away.

Also he called to my home a few months ago and tried to step pass my young daughter and enter the home when I wasn't there even thou she had had stressed my son has never lived here.

Alas Bailiffs have one weapon and that is fear. They have no other tools in their box and that's why they feel intimidating.

Do you have an address for your son? Should your son not be the one to take up the reins here and deal with the bailiff form themselves?

All you have to do is to firmly state that your son does not live there ( council tax bills and rent agreements have no bearing of proof ) and state on those grounds alone you are denying legal access ... if you feel that the bailiff is using intimidation beyond what is necessary, then call the police, or threaten to do so.

But really, the bottom line is that your son should be dealing with this, it is not your problem.

I have no forwarding address as apparently he sofa surfs!!! As waiting on his army enrolment date. I have spoke with this bailiff and explained yet again my son does not live here and he's been intimidating towards me as I said saying he would put my door in and all he wants is to come in and look around what that is meant to solve I don't no!! I'm guessing if I grant him access he has the right to then break in with a lock smith I refused......and then he put the phone down on me. So I replied by texting him saying that I would refuse him access and if he tried to intimidate me at my home I would call the police. He never replied

I don't suppose you recorded the call. If he comes to,the house or rings record the situation. He has no right of access until you give it to him. Once he has got in then he can force entry . The bailiff is paid on the amount collected.
