  • Newlyn plc help

    Basically i have had a debt with southwark council for an unpaid parking fine which they then sent onto newlyn debt collectors i paid 250 of the debt and spoke with the council to try and dispute it as i was paying they basically said the debt on there end has been payed off so not to pay anymore money so i stopped paying and npw newlyn are saying they are coming to my home to remove goos because i owe them £360 and that o have to pay in full to stop them coming tonight to remove goods. I have tried to explain i dont have that money upfront but they wont take it as i missed payments as i was told by the council not to pay anymore to them. I also have my daughter who os 9 months pregnant living with me and her one year old daughter im scared they will cause them stress.

    I do apologise for not responding sooner but I have only just seen this query.

    The problem as I see it, is that you made payment to the council instead of to Newlyn. If you look at the initial letter that you would have received from Newlyn it would have clearly advised you that payments should be made to Newlyn and NOT to the council. Is there a reason why you did this?

    The letter from Newlyn would have also advised you that if payment is not made to them by a specific date that a personal visit will be made and an 'enforcement fee' of £235 applied. It would seem that this is happened.

    Also, you mention that when you made payment to Southwark that you wanted to dispute the ticket. The worry about this is that once a warrant has been issued, the period in which to 'appeal' a parking ticket would have expired. The only time to 'appeal/dispute a penalty charge notice, would be on receipt of the original Notice to Owner from Southwark which would have been a few months ago.

    Did an enforcement agent visit last night?

    The bailiff may only come into your home by invitation and I would not suggest that you allow him into your home.

    The problem that you will have though is that he can clamp your vehicle. Do you have a vehicle? How much roughly is it worth?

      I payed through newlyn i never paid the council straight away because i had my post from the royal mail being held i didnt recieve any letter about the parking fine until i got a call from newlyn saying they have the debt. So i paid them £250 and i was advised by my local council that i could file a out of time form to dispute the ticket which i didnt have on me so i called the council to ask for the ticket number which is when they had told me they had nothing on the system for my vehical the debt has been paid and not to pay newlyn any more money. He didnt come round thankfully but i am still scared he will turn up at any time. I tried to call him last night to reason with him but he would not have any of it. I dont own a vehicle anymore i got rid of it last year. Also they said they sent someone round at the begining of the year but no one was home so i asked for proof as there was no letter left or anything that would suggest someone had been to the house and they said i would have to pay even more just for a letter to be sent to me with proof but that letter could come after a visit from the bailiff anyway. They are just trying to get more and more money from me which i dont have.
