  • Car accident small claims court

    As the defenant of this claim I have sent off my defence and I have also sent off the questionnaire to the claimant

    I am unable to afford a solicitor
    Firstly how do I go about legal aid
    Secondly this is an accident from 22 months ago and its the first correspondence I have reviewed about this incident since it happen the insurance companies took care of damages
    I am now being taken to court over the coats of a hire car that the claimant chose to purchase 13 days after the accident

    Have you referred it to your insurers?
    If the other party is claiming from you it is is a Third Party claim and should be dealt with by your insurance company.

      When I wrote my defence I clearly stated that the insurers had dealt with damages back in 2014
      So I am unsure why it Is now I am receiving this
      She isn't claiming for loss earnings or damages but is claiming for taking our a hire car
      Again I am unsure why it is me being taken to court
      As also the accident happened while I was a driver for a company

        You have received a claim for out of pocket costs following an incident.
        This should be referred to the insurance company who dealt with the original claim.
        This is part of the claim and you should not have tried defending it before telling your insurers.
        The insurers dealt with he direct damage to the car. The third parties costs (including car hire costs) are part of the damages, which only now the third party have claimed.
        Phone the insurers first thing tomorrow!

          That's where it gets complicated
          I was renting a van off a company who received there vans from else where
          The company I rented from dealt with the insurance companies
          It's best I contact them then?

            YES this is a claim which needs to be passed to the insurers as soon as possible.
