  • Nationwide CCJ and charges help

    I received a letter from nationwide in January stating charges on my account did not meet the consumer credit act. They stated that they will be amending my account and returning the interest/fees that were wrongly applied, also they have stated that my CCJ will be removed.

    I have sent them a letter asking for my account to be amended and for my CCJ to be removed immediately (this is preventing me from getting a mortgage).

    They have responded saying that they are in the process of reviewing accounts and will be in touch before the end of the year.

    Personally I don't think this is good enough, does anyone have any advice in which I could sent them a letter demanding the my CCJ is removed immediately and for my account balance to be adjusted.

    to take such a long time to remove a CCJ that has a profound effect on your credit report is clearly not good enough. If they have acknowledged they are at fault and the CCJ is ineffective then I would challenge this. I suppose you could be proactive and offer to send a application to set aside wih consent and without a hearing and they refund you the application fees back.

    Or alternatively you could press them further with the threat of legal action for incorrect data reporting and damages if they don't comply within a period of time. If there are a high number of accounts affected by this then it would reasonable to offer a longer period than the usual 14 days maybe 28?

    Up to you how you would want to proceed.

      I sent them a letter threatening action and Nationwide telephoned me today. They have told me that £1500 was incorrectly charged to my account and they have reduced the balance by this amount.

      They have also stated that the CCJ and charging order will be removed but was not able to confirm timescales. I have requested that they put this is writing confirming that they are in the process of removing the CCJ and have contacted the land registry regarding the charging order.

      I can imagine the CCJ might take a while but the charging order should be a simple letter to the land registry?
