Threatening letter from QDR Solicitors!! CLAIMING EBAY DEBT

about 4 months ago, maybe a little longer i sold a designer jacket on Ebay. The buyer claimed the jacket was damaged and requested a refund, claiming that he had sent the jacket back. However the jacket i received wasn't the one i sent out as he sent me a worthless plain black hoodie. I therefore contacted ebay and opened a case, however they took the side of the buyer leaving me £180 out of pocket. i have since been getting letters, calls, text messages etc from from a company called Akinika. from what i have found online they were sending empty threats so i ignored all their attempts to make contact with me... However i have received a letter &nbsp;today from QDR Solicitors demanding i pay the money within 14 days or they will look to obtain a CCJ (county court judgement)<br><br>I'm hoping the is just a tactic to scare me into paying but it has got me a little worried.<br><br>If anyone can advise me on what to do and if QDR have any authority to carry out any of these threats.<br><br>i have attached the letter i received.<br><br>THANK YOU

Just to clarify did ebay say you had to refund the buyer and did you?

yes they did. Ebay took what was in my paypal account which was around £30 and they paid the rest (£175) they are now wanting me to pay ebay the £175 they paid the buyer. im guessing they have sold the debt to QDR who are now looking to collect from me. However i have no interest in paying this money as i provided ebay with pictures of the jacket he sent and spent countless hours on the phone with them resulting in a loss of money and my jacket.

The debt is in the hand of Debt Recovery Company Akinika QDR are solicitors acting for them.

It's unlikely that QDR have bought the debt, they'd be acting for either Akinika or ebay.

I would respond to them setting out what happened and say that if they issue a claim you would issue a counter claim for the loss of the jacket and the £30.

As far as I know Ainika is not a debt purchaser.

QDR are the debt recovery arm of Wright Hassall.

Akiwosisface is just a DCA.

No, they're just threatening to issue a claim which if they do will be done by post. I would engage with them setting out why you think that you are the aggrieved party.

It's a very long way from bailiff or HCEO involvement.

just to clarity, would ignoring it be a silly thing to do? as im a uni student in the middle of exam season and would rather be spending my time studying than dealing with debt collectors. Or would you recommend doing what you previously stated? sorry for dragging on but i dont really have much experience with these types of issues and really appreciate the two cents of anyone with a bit more knowledge.

IMO you have two options:
1, Write back to QDR disputing the debt using the grounds you stated in post#1 (which might delay things while you concentrate more on your exams)
2, Ignore all barring a court claim (which we would happily help you to defend if it came to that).

The choice is ultimately yours ... although if you have screenshots/pics of the returned item and your ebay ad (plus copies of correspondence etc...) I think you'd have a good chance of winning xx

thanks for your reply. i do have pics of the returned jacket however i am unable to gain access to the ad i posted as they have now suspended my account (not that i will be wanting to use ebay again) but this disables me from viewing my ad. I spent countless hours on the phone with ebays helpline and everyone seemed to understand the situation and agreed that i was the victim in this case, however the outcome showed otherwise.

have you thought about sending a SAR request to ebay (it'll cost £10, but you should get all the info they hold on you ... possibly even screenshots of your previous ads )??

Being an arkward old git that I am, I think the guy that bought the jacket on ebay and sent you a grotty old thing back is a con man and I bet he has done this before.
I would tell e-bay and those solictors that you believe that you have been a victim of a fraudulent act and that e-bay are complicit in that act and the only way they can avoid that allegation is to let you have copies of the ad you placed on e-bay..............might get some action...............then again tell them you believe the police would be interested in this as they watch e-bay for other kinds of scams................others might disagree with my take on this ............but I do things others don't .........which sometimes get results.
