Llowell can't find signed docs

Hi all,

I have had Lowell chase me for a debt but thgey cannot produce an originbal signed copy of the credit agreement.

What powers do I have on this?

Have they issued a court claim?

If you give us a bit more info you'll get more help from the Beagles ... a pre-2007 (?? :bump: for @nemesis45 ) agreement needs to be a true copy, after that they could use a reconstruction.

As Kati has said we need more history /info on the debt.
What has Lowell said about no having an agreement?

When was the account opened?

In certain circumstances a " reconstituted " agreement can be provided which does not have to contain signatures, Lowell has used this approach in the recent past.

so, what's happened is ... Lowells sent you a letter about a debt? You sent a cca request (asking for the agreement)? They wrote back saying they cannot produce one? (am I right so far :noidea

I'm waiting on that letter from Lowell's currently, they have said on the phone.

A previous company tried this on me last yr, cant remember name.

The contributors on LB Mr Hightower are volunteers people with families and jobs and it is a bank holiday weekend we all need a break sometimes.

You sent a CCA request off to a previous owner and they wrote back saying that they couldn't find the documents?

Lowell have now bought the debt and you sent another CCA request off?

They might, just might come back with a recon in which case that needs dealing with

If they come back saying they can't find it just keep that letter and if they sell it on again (which is likely) just write to the new owners telling them that on xxxxxx you sent a cca request to Lowells who wrote back saying they couldn't find the agreement - that often results in the account being sent back to lowells

Maybe you could just give us an outline- credit card, loan, overdraft?
Who was the previous company that couldn't find the signed agreement ?

As new said , weekends are quiet on here and BH weekends especially so however sometimes threads get missed so a bump is often useful

I know that i sent letters to some creditors asking them if they actually had the signed agreement under CPUTR and some wrote back saying no. I haven't heard from them in a couple of years

There was no written signature by myself so this has me wondering how enforceable this debt is.
Can I get them to strike this off my credit report if so?

I am assuming that this is what has happened based on what you have said.

I am afraid the lack of a signature doesn't mean they can not report to to credit reference agencies wrong as it may seem

The underlying debt though unenforceable via the courts remains payable and can be reported to credit reference agencies until the remainder of the 6year "life" of the default expires when it is automatically removed.

Oh well not long now I suppose. I believe I'll have credit agencies chase after me forever more then?

To be honest
Once you have sent your CCA request off and they have written back saying they can't find one , the letters seem to tail off, every know and then you get one but less often.

When you get a letter from a new DCA just write back with
I sent a S77-79 request to DCA xyz and they replied saying they were unable to find it

Once you have gone 6 years without paying or written acknowledgement you could write back saying
please note this account would be Statute Barred

And they should run off with their tail between their legs
