    Hi,

    Sorry to just jump straight in...

    I was a member here in 2011. Back then using this forum I learned how to fight an unfair debt with a CCA request. It was Lowell/BW Legal who arranged the CCJ against me. I sent the CCA request and they replied by closing the debt/account and advising no further action was required.

    However today I have received an 'Annual Statement' stating I am in arrears and owe money. The original credit agreement is quoted as 30.01.08 Lloyds and last payment they received from memory was August 2010 - so as a side this is due to become statute barred.

    A more organised person would have the letters from years ago when they told me the debt was written off. But I haven't. I've moved and have no record of our communications.

    Should I go back to the CCA request route?

    Should I reply and advise them we've already been through this? Knowing that they will ask for proof.

    I'd rather not ignore until statute barred as this is a bit slack.

    What approach would you take?

    Hi Was a CCJ actually made?
    Or just a claim issued but not taken to trial.

      Nem,

      I recall a CCJ was made and I submitted a defence and sent of the CCA request. Three weeks later they replied and said it was all over.

        I can see what happened the claim may well still be stayed i.e. remains on hold and I suspect shown as such in Lowell's records hence the annual statement.
        Not the first time I've seen this by a long way.

        Was this a claim vis Northampton County Court ( was bulk now Business) Centre if you have the details claim number and dates I would advise you check with the court to see if this claim is stayed.

          Thanks for the info Nem. I think you're right.

          I think it was NCC but I cannot be 100% certain.

          Either way I only have vague dates, no claim number and no other information.

          I was considering checking 'Trust Online' but I don't think this will list a claim number.

              OK, I'll save £10 then.

              It looks like I'll have to send a CCA request again, however this time I'll keep all records! And send a closing letter to ensure it is taken off my credit file.

                  I'm not certain what a CRA file is - Is this my Credit Report or court related? Sorry if that sounds stupid!

                    CRA = Credit Reference Agency (Credit Report) xx

                      I'm just waiting for Experian to do the ID check then I will know. TBH I think it will be on there if they have only put the debt on hold.

                      In the meantime I'll send a CCA request - pah - recorded delivery, £1 postal order grrr. Oh well, got to be done!
