Sorry to post again but am wondering if I should be sending of the next letters today as I acknowledges service yesterday. How do I know which letters to send as am not sure if debt is a loan/overdraft etc. Thanks :-)

Thanks Kati - I started to the follow the steps but I got confused with which letter to send as one of them says it is not relevant for overdrafts and at this point I am not sure what the debt is for and don't want to send the wrong letter. Also I have to file my defence within 33 days of issue - what if they haven't responded by then?

The PoC says it's an agreement "regulated by the Consumer Credit Act", so I'd say you're safe sending the CCA because of that
The CPR is where you request documents mentioned in the PoC, so you can ask for a copy of the agreement the notice of assignment and the default notice

There's a template defence HERE that you can look through ... if they don't send the docs then that would be mentioned in your defence when you file it.

OMG I can't believe I didn't even realise that CCA letter and Consumer Credit Act are obvisouly the same thing!! Need to stop panicking and actually focus - contrary to above posts I am fairly intelligent and together usually!! Thank you so much for getting back to me and for your advice - will get these letters done today :-)

you might as well Chippie

CPR = because they've started a claim
CCA = because they say the 'debt' is regulated by the Consumer Credit Act

It looks bad (for them) if/when they don't comply
