lowell pre-legal assessment/ orange debt

  • lowell pre-legal assessment/ orange debt

    Hi all
    I received a pre legal assessment letter from lowell about a debt i have with orange. The problem is i cant remember this debt at all. What would be the best way to get information about the orange account. Do i contact EE or is it lowell i ask. Many thank in adavnce

    Is it a 'Letter Before Action' (ie mentioning possible further action)?

    Could you post it up here? (Suitably redacted - ie, personal details obscured)

      Good morning Mac,

      A simple free online credit report from a company such a Noddle will/should give you the info on the debt.

      Look at the default date an the account history.

      If the Lowell letter quotes an account number ( be aware that Lowell has it's own numbering system) which you can identify as an Orange account you could try a call to EE they may give you some information.

      You can always send Lowell a " prove it" letter asking for evidence that the debt is yours.

        I would most certainly be sending a prove it letter if you have no memory of the debt.Do this in conjunction with a check on your credit file but certainly get that prove it letter sent

          Thanks for getting back to me so quickly.
          The letter states
          We refer to our previous letters. Unfortunately we've still not agreed with you how you'll repay your debt with us and therefore it has been escalated for legal assessment.

          You can still discuss this with us before it escalates further. We will not ask you to pay more than you can afford, so please call us on ********* or visit our website to pay by installments.
          If you dont do this and we decide to use the county court to recover this debt,the court process will be as follows.
          1. You will receive a claim form from the county court claiming the outstanding balance plus court fees and solicitors costs.
          2. If you still do not pay,14 days from the date of the claim the ccj will be registered against you unless you file a genuine defense.
          The CCJ will stay registered against you.for 6 years, unless you pay within 30 days.


          *What enforcement means

          Enforcement is a county court process which allows us to use the courts to recover the amount of the CCJ. An example of enforcement is an attachment of earnings. This means your employer would be ordered by the county court to pay them directly from your salary until the CCJ is paid in full. The county court would then pass the payments onto Lowell.

          The last thing we want to do is take enforcement action so please visit the website www.lowell.co.uk and set up your repayment plan today or call 0844 815 0682 where an account manager will be able to help you set up an appropriate payment plan.

          I will be getting in touch with EE, today, where can i get a template for the prove it letter to use. Do i have to post the letter or email it.
