  • Specifics of CCJ entry into the register.

    I successfully brought a case against a company that owes me money last year. I won the case in June '15, and was awarded £1.1k by the judge sitting at the county court. The terms of payment were 28 days.
    The company then followed the appeals route, but their application to appeal was denied in September '15 and the stay on enforcement of the judgement was lifted. To date, the company has not paid the debt and I have heard nothing from them.

    The latter half of last year was a busy time for me, so I haven't yet taken any further action - this has only recently bubbled back up to the top of my to-do list.

    Whilst weighing up my options for enforcement I have today performed a CCJ search against the company via trustonline, in all of the available registers. The company is showing as having no CCJs registered against them.

    I was under the impression that CCJ entry was automatic if the debt was not paid within the specified timescale - is this not the case? Is a CCJ only entered once the creditor commences enforcement?

    Yes you are right about this, if you have an order from the court or confirmation that the stay has been lifted, send a copy to Registry Trust online, and also to the court with a covering letter saying that although the stay has been lifted, no CCJ has been applied and please confirm the CCJ will be entered effective immediately.

      Thanks for the confirmation, I'll draft those letters tonight.

      Which is the appropriate court to send the letter to; is it my local county court where the initial judgement was made, or the court that the case was passed to upon appeal? It is the latter that ordered the lifting of the stay on enforcement.
