    Hello. Please can anyone advise on the following letter received from that man Bryan Carter

    "we write further to your recent letter 01/12/2015 requesting disclosure pursuant to part 31.14 of the civil procedures rules.

    We confirm the claim form was issued by the County Court business centre and that the courts protocol was followed when issuing the claimants particulars of claim
    Practice direction 7C point 1.4 (3A) eliminates the requirement to attach the documents to the particulars of claim when they are issued by this court

    We confirm this matter will most properly be allocated to the small claims track as this is a simple contractual matter and part 31 of the civil procedures rules will not apply

    In any event the notices of default and assignment left the control of the claimant when they were dispatched to you

    It is the original creditors policy to issue agreements at the start of the contract and statements throughout the duration of the agreement and, in this regard, we ask you to refer to your own records.

    We confirm our client is not agreeable to an extension for filing your deference
    We recommend you seek independent advice

    Standard Carter Template!!

    Normal reply is CPR 31 .14 is still applicable to a this claim until it is actually allocated
    to the Small Claims Track, please provide the documents requested within 7 days from the
    date hereon.
    Failure to provide the documents will be brought to the attention of the court.

            just an update
            bc sent a reply back today saying there reiterate fron there last letter dated 31-12-15 and reccomened i seek legal advice
            think ive lost this now as i have also received the court allocation letter this morning

              does nyone have any advice on where i stand now please, BC wont provide crp31.14 now court allocation has been set. do i have any thing left a leg to stand on at all.
              the debt is for a 5 year old phone debt. lowell to bc. however the debt should be SB in feb as it will be 6 yrs old. also the contract was taken out when my partner (whos debt it is) was 17 any help will be really appreicated thankyou

                  OK Carter/Lowell at their worst.
                  The debt cannot become statute barred as the CC Claim stops the 6 year clock on the date of issue.

                  Now a 17 year old cannot make a contract so do you have that the contract was signed when your
                  partner was under age.
