  • Newby alert!! Very scared!

    I have today received a letter from a debt collections agency.
    It is addressed to me and provides a reference number which I am to relay to whoever takes a phone call from me to a company called "DLC".
    I did have 2 credit cards from MBNA dating back to around 1999. By 2002 I managed to flee with my child a horrific relationship. However the man (if you can call him that) had used my credit card without my consent!!
    Needless to say I was left with thousands of debt. I have been paying a company called Robinson way £5 per month without fault and this has now been paid off (took years however I'm glad that I used a standing order!)
    I provided both MBNA and Robinson way with a forwarding address (as I needed to flee ASAP until I found permenant residence) ad this address has always been used by Robinson way for the past 13 years!!!
    I heard nothing regarding the other card until today???
    I no longer work as I went on to produce a further beautiful child with my then husband, unfortunately the Baby was profoundly disabled and the past 9 years I have been enduring the life as a full time Carer.

    What on earth am I to do?
    Do I contact this company, DLC, and ask them why they are chasing me for an unpaid debt from 2002/2003?
    I know it will possibly amount to thousands and I most certainly do not have access to money which I once did.

    Since the experience with my ex partner I have been yo scared to take out any form of credit as I have been petrified of someone steeling it?? Frogmarched by knife point was not good, hence giving him my pin otherwise I was in fear that he would kill my now 15 year old daughter

    Gee whizz, I do "hope" that someone is able to point me in the right direction??

    Ps I am of the assumption that the debt collection agency are making a reference to that credit card?
    No monetary amounts were provided or who they were acting on behalf of?
    Is it a scam letter?
    Should they be causing me so much stress after hearing nothing for so many years?

    Hello! First of all - you should live in hope! Its only a standard letter; nothing to get worked up about. Relax!!! They send millions of these each year. Second - dont ignore the letter but don't phone them. Third - someone will be along soon to advise you on what letter to send them. If they think you owe them money it will be up to them to prove it. You dont have to prove anything to them.

      Good morning welcome to LB,

      DLC is a collection agency in the Cabot Group of companies.
      Please don't let this bunch scare you,
      DO NOT Phone Them!
      It's not a scam, the old debt has been sold by the card issuer to
      a debt purchase company.

      So I can help you please answer the following.
      Do you know which card issuer you had this card from.
      Do you know when the last payment was made to the account.

      Do you ever check your credit reference files? If not it would
      be a good idea to do so, there is a FREE Credit Reference Site
      Called Noddle Online.

      The good news is that from what you say I think that this debt is
      Statute Barred ( Cannot be enforced in court).

      To Clarify a debt (in England & Wales) becomes statute barred if there has been no
      payments and written acknowledgment of the debt in 6 clear years.

      Is the letter just an introduction to DLC? Could you post a copy here
      after removing your name and address or type the letter in here please.

      With the help from the answers to my questions I think we can be rid
      of DLC pretty quickly.

        The letter, from recollection, simply stated by name with a reference number. They stated that I need to contact them o a number. There was no mention of which company I may have a debt with. As suggested, an invite to respond to their letter.

        feom recollection the last payment made to MBNA was around 2003.

          I think this is a wait for another letter, if it happens, situation. They are fishing for a response at the moment, hoping they have found you but they are not sure. No phone calls! If they call you then just say you do not know who they are and do not wish to talk to them and hang up. You could tell them that as your telephone number is registered with the TPS (Telephone Preference Service) this is an unwanted call, not to call again and it will be reported to the ICO if they do.

          They could, of course, be looking for someone else with similar details.

            Ok When a company such a DLC doesn't mention exactly what there business
            with you, they are unsure of their ground / right person?? It's in the hope you
            will phone and answer all their sill questions and be coerced into making payment.

            OK 2003 last payment, even at a rough guess leaves no doubt in my mind that
            the debt is statute barred, that is if it is the MBNA account.

            A suggestion,

            To DLC,


            Date:

            Ref: use the one on the letter.


            Sir/Madam,

            I refer to your letter date ..................: which provides no information as to what it refers.

            I can however having researched DLC conclude that it is pursuing an alleged debt,
            thank you for prompting to review my credit history this has caused me to conclude
            that any alleged debt DLC or its parent company may hold is Statute Barred under
            the Provision of the Limitation Act 1980, therefore I do not acknowledge any debt tp
            DLC or any company it may claim to represent.

            I will not at any time now or I the future make any payment or offer of payment in
            regard to a Statute Barred debt.

            DLC will now confirm in writing that it has closed the file on this matter and has
            ceased to process all data relating to me and has removed it from all records.

            Your etc.


            Use signed for post and check delivery date.

              Phew, thank you for the plethora of guidance. My fingers are at the ready to compose a letter (medical gloves on, peg on nose and clinical waste bin to be explored for letter retrieval).
