      I have received an email reply from Bryan Carter. Does that mean they are going to fight the set-aside? Also does anyone have any advice on how best to fill in the court form?

      Thank you for your email.

      We reiterate the contents of our previous email dated 2 December 2015 in that our client is not agreeable to setting aside Judgment as you were properly served with the Claim. However if you wish to make an application to the Court, we shall wait for the Courts Orders.

          I have decided I am going to apply to the court for the 'set-aside', I am hoping that being able to prove I had a high income at the time & was also paying another debt with Lowell will help to show I had the means to pay the CCJ in full had I received the forms.

          Can anyone help with filling out the form? I don't understand what half of it is asking but want to get it completed & sent out asap

                3. what order are you asking the court to make & why? do I just put... set aside CCJ as forms were not received ?

                4. have you attached a draft of the order? do I just tick... no?

                6. how long do you think the hearing will last? I haven't a clue what to put here

                9. who should be served with this application? do I put lowells or bryan carters?

                9a. please give service address other than claimant or defendant. Do I just leave this blank?

                10. what information will I be relying on... do I tick the evidence in the box below?

                In September 2015 I signed up for my credit report. I noticed a CCJ was registered, I contacted the court & was informed Lowell had registered it due to an unpaid 3 mobile cancellation charge. Prior to viewing my credit report I had no knowledge of the debt. I had received no communication from Lowell with regards to the debt. I do not dispute that I owe the debt & I do intend to pay in full. I can show that at the time the claim was made I was already paying Lowell a £60 per month direct debit for another debt & with my earnings at the time I would of been in a good position to pay the debt had I been notified/received the claim forms.
