    Hi Everyone,

    I'm new to this & need a bit of advice as I haven't a clue where I stand with this.

    I recently checked my credit report & noticed a CCJ had been registered. It didn't say who it was with so I contacted the court & was told it was due to a debt with Three mobile. I contacted Three regarding this it took a few months but I finally got it out of them that the debt had been passed on to Lowell & it was them that registered the CCJ not Three.

    Now, on my credit report the address where the CCJ is registered was my address at the time but my mum had kicked me out & I was living between my friends & girlfriends house for a few months. I never received anything to say they had applied for a CCJ & I have never received any correspondence from them, I was unaware they had taken over the debt until Three told me. Is there any way of having this set aside? I am not disputing the amount & will pay it in full, my issue is that if I had received the forms in the first place I would of paid the amount to avoid the CCJ. I can prove my wage at the time as well to show that I had the means to pay had I received the forms & been given the change to repay

      Hi welcome to LB.

      There are indeed some ways to get the CCJ set aside, first*** when was the judgement made? ***Set aside applications should be made as soon as possible after judgement.
      Lowell obtained the judgement as the " new owner " of the debt and a such are not the easiest to deal with.
      Convincing them to consent to set the judgement aside wont be simple, but worth a try.

        Thanks for your reply. The judgement date was June 2014. I only checked my credit report for the first time in September 2015, this was when I contacted the court & Three. I only found out that it was Lowell who applied for the judgement last week when I received my SAR documents from Three. I haven't contacted Lowell yet as I'm unsure how to proceed?

                      Are Lowell chasing this judgement?
                      If you want to get this set aside you can state that the documents were sent to a previous address.
                      What is important is did you have a defence to the original claim that had a reasonable chance of
                      success.

                      Alternatively you could put it to the court Lowell that if you had received the court claim you would have
                      paid immediately in full.

                      Application for set aside is made on Form N244 the Court Fee is £155.00.

                          I have emailed Lowell today asking if they will consider setting aside the CCJ due to not receiving correspondence from them & I will make payment in full. Will see what they come back with & will proceed with applying to the court if needed.

                            It would be wise to put a copy of your e-mail in the post by signed for post, e-mails to Lowell
                            have been known not to reach the right person or indeed anyone at all.

                              Hi Nem,

                              Can you help? Lowell have replied to my email this morning. They have said the account us been passed to Fredrickson for collection & I should forward any correspondence to them. Is that right? As the CCJ was registered by Lowell
