  • MKPD have sold a Barclaycard debt to Hoist Portfolio

    I would welcome any advice as I am not sure how to proceed!!!!!!
    In July 2014 I received a CCJ by Acceptance in favour of MKDP who had bought an old Barclaycard account. I realise now that I should have issued a CCA request to MKPD before the claim was ever made as I am almost certain that they will not have the required documentation, however when I received the Court papers I made an offer of monthly repayments to MKPD and this was accepted. I know that this sounds rather naive now but I did not realise that this would still lead to an actual CCJ being issued!!!!!
    Anyway, I have been paying regularly each month until this week I received a letter from Hoist Portfolio Holding 2 Ltd saying that MKPD had now sold the account to them and that HPH2 ltd had appointed Robinson Way to manage the account on their behalf. In the same envelope was a letter from Robinson Way 'introducing' themselves and informing me that the payment arrangement had now been set up with themselves and I was to start paying from next month.
    As an almost P.S. to this letter they added that 'they were aware that previous legal activity had been taken on the account and that their client's solicitor would be applying to the Court to change the name of the Claimant to HPH2 Ltd and that the Court would write to me to confirm this once the process was complete'.
    To date,I have not received ANY notification from MKPD concerning the matter.
    Can they actually:
    a) Sell on an account that is the subject of a CCJ?
    b) Have the name of the Claimant just changed on the current CCJ?
    Do I contact MKPD for verification of all this and/or do I wait until I hear from the Court before making any further payment?
    I am so sorry this has been so long winded but I am really worried as to how to proceed!!

    Hi my husband was taken to court by Mkdp last December we had requested all the relevant information in our defence and the judge also requested that mkdp supply the evidence prior to the hearing.. On the date of the hearing they had not submitted the judges requests nor did the turn up so the judged dismissed the case.. A year later we too have hoist portfolio sending a letter saying they have been assigned all of the rights and duties to the debt and will be applying to the court to have the name change and that we are to make payments to Robinson Way... I can't work out if this is legal being as the judged dismissed the case on claimant not complying with paragraphs of the order? .. Any light shined on this would be appreciated xxx thanks peeps

      Hi welcome to LB I'll take your points as they appear.

      (a) Yes a debt can be sold on even when subject to a CCJ.

      (b) Again yes this is quite common.

      Wait for confirmation from HP that it is now the " claimant"., confirm to RW that you are doing this.

      There is little to be done now as the CCJ supersedes the original agreement

                [MENTION=1937]nemisis[/MENTION]45 we have received a court order not sure how legit it is but it's justice Henderson that authorised the change of deed from mkdp to hph2.. They are now claiming we have to deal with Robinson Way to repay the debt that was previously dismissed at court as mkdp did not adhere to judge parkinsonism requests... I understand that mkdp and hph2 have the same po box address... What do we do now the debt was from 2008 and shows as settled on eqiluifax from barclays point of view judge Henderson sat in private with no hearing when he made hph2 the new owners of the debt that mkdp could not provide evidence for... Hence selling or assigning it on.. Any help would be much appreciated xx

                I have seen that hoist portfolio are not licensed to collect debts... But are employing Robinson Way to collect such debts on thier behalf it seems x

                  Good morning,

                  What you nave received is notice from the court regarding a " portfolio " of debts transferred to Hoist by MKDP this order refers to many debts/claims and is an administrative process and it does not affect the status of your claim i.e. Dismissed!

                    Ok so does the judges dicission of dismissed mean that hph2 have to accept that they cannot continue to pursue the debt? Thanks mrs c

                      The application to the High Court it appears has been made without any consideration to the status of the claims being assigned to Hoist, it was just a list of numbers no names or other ID.
