Lowell chasing statue barred debt

    Hi guys,

    Its been some time since i've been able to get to the bottom this Lowell debt. I contacted Step change charity and it took some time for them to get back to me and advise me whether a payment had been made. They did however go in the archive and confirm that they paid Lowell £5 which means the debt is not statue barred. Since then Lowell have been bombarding me with letters/phone calls (I have not answered but they have left messages) about this debt and two others which they claim are legally enforceable. Just wandered what the best course of action to take now is? The debts are some years old and not on my credit file but the payment from SC charity reset the limitation. Would you recommend me giving them an offer for all three debts as I just want them out my hair at this point and dont want a CCJ...any ideas i'd welcome. Thanks

        Did SC make the payment with your authority? If not then you might be ok. There is a similar case current on beagles at the moment where the opinion is that because it was not made by you or without your permission it does not count as a payment to stop statute barred.

          SC made the payment as part of my DMP - DOES this mean they had my consent? Can you point me to the thread your referring to so I can check it out..Thanks

              Unless you had instructed the DMP not to make or any payments to this debt or had told them in writing to
              cease payments, the payment will have reset the 6 year clock.

                Thanks for that Nemesis. Moving forward shall I make an offer payment. They are now saying there are two other debts too.

                  Just for clarity was this debt included in the DMP?

                  What are Lowell saying that is holds two more debts of yours? Have they given details?

                    Yes the debt was included on my DMP. They have given the details of the two additional debts also and want payment of all three now.

                      Post up the details of the other debts with some history we can see then what can be done, what you
                      don't want is Lowell to consolidate all 3 into 1 large debt.

                        The two additional debts one is for £1454.63
                        And the other £230.
                        The orginal one which I assumed statue barred is for £270.
                        I'm going to check the HSBC debt as I don't think that was on the DMP but ill confirm with step change later. If not that is I'm sure statue barred

                            I've just got off the phone to stepchange. They say that they made a payment concerning two of the debts on the 14/12/2011 via bacs for £6.94 and the other £6.24. Lowell are saying payment was made on 16th for £5.00. So there is definitely some discrepancy.
                            The debt for £1454 was not on the DMP so no payment was made. SC say there is no lowell ref for this so the debt may have been with another company and not lowell themselves. How do I proceed given the above? Do I ask them to prove the payments ie how much and via what method to gain some time and plan what to do next ?
