  • Debt & Financial Advice & Guidance PLEASE

    Hi I am hoping that someone can offer me some advice regarding debt and the best way forward.

    Myself and my partner both got divorced from our previous marriages and although we have been together 4 years the divorces are fairly recent and we now want to know the best way to deal with our debts as we are struggling each month and have very little to live on.

    Our debts total appx £27000 (mine are £6000 and my partners are £21000)

    Mine are a mixture of credit cards, unsecured loans (payday - yes i am stupid !) and other minor credit facilities.
    My partners are 2 credit card debts plus the likes of a next account.

    We both work however pay isn't great and i am currently off sick and only receiving SSP for the next 2 months until i return to work after an operation.

    The house we live in is owned outright by my other half - we could possibly look at getting a loan as the house is worth enough BUT our credit status is not great as we battled through 2 messy divorces.

    Bankruptcy is not an option as we dont want to lose the house, is an IVA the best option and would we need to apply seperately ? this would not be an issue for us at all.
    OR
    Is a DMP the best option??

    We probably have realistically £300 per month between us that we could afford to use to pay off debts...

    Any advice or guidance is appreciated as we just need that little bit of help as once we can get this sorted then we can sleep easily.

    you do not scrape £300 a month, you try and come to an agreed amount which is comfortable to you both, scrapping always go wrong as no room for monuvering , what most lenders would need and can get these days is a charging order against property, but can only do so with the owner if not joint property, but others will be along and no doubt ask for breakdown of type credit - who owed to - Loan or credit card etc etc enforceable or not, so suggest sit down and make a list of each and give details like a diary? for starters no personal information though!

      It would be useful if you could tell us a bit more about your debts such as:
      • Who was the original lender
      • Who is the current owner
      • What type of account is it
      • Approx. amount outstanding
      • When you took out the card or loan
      • When you last made a payment
      • Anything else that has happened since defaulting

      Based on your responses to the above, it would be possible to assess who is more likely to take action and succeed and that's where you should concentrate your efforts (and any available money). :thumb:

        Thanks for the above info - I am out at the moment but have everything written down - I will update the thread tomorrow with details of the debts - without any identification etc... we have kept the big boys upto date but thats where we struggle with daily living....

          Hi are all the debts still with the original credit providers?
          Are any with debt collection agencies working on behalf of the original creditors?
          Have any debts been sold to debt purchase companies?

            Thanks - i can reply fully tomorrow when home, some of my debts are with original creditors and some have been sold to companies. My good ladies debts are all with original creditors...

                  Hello Stav,

                  Quite a list but non are delinquent as yet, so I suggest a letter to all the creditors stating what has happen in regard to your
                  health and income ask for a temporary freeze on interest and a " payment holiday" until you are back at work full time.
                  I would expect the creditors to require proof etc., so just send details with the letter.

                    It would be much better if you could post up the details on the forum rather than sending them by PM, so we can all comment on them, :typing: after all that's what forums are for.                       Just check isthere is there sickness insurance with any of them? If so it migh be worth a claim .
