        So guys to keep you in the loop (and to thank you all again)

        After 8 APS cards and numerous calls to them and to IND to make them aware I was not dodging them and very much want to get this sorted, They finally knocked last night close to 8pm. Some young student looking guy asked my name and passed me the "ORDER TO ATTEND FOR QUESTIONING" for the 10th of november.

        After speaking to a solicitor last week, they have advised I stand very little chance of getting anything on this and re assured me that the questioning is not to daunting as I am a little terrified!

        So, I sucked it up and know I owe the debt; I don't agree that I should pay so much as I feel the charges are so unnecessary, but I figured if I make a large monthly offer, and work my nuts off, I can clear it inside 4 years.

        So, my appointment is on the 10th of November at the local court. I am getting as much of the information together as possible. all bills etc.

        I have just arranged an appointment with CAB to see if they can re assure me on this also - its the unknown when it comes to these things... I have this image that the court officer is going to tear through my bank accounts and pick on beers here, days out, breaks and lottery etc!

          Sorry for the bump guys; But thought I may as well answer as I'm hoping someone may know.

          1. Do you know if there is a way of requesting the interest to be Froze when I agree a payment plan?
          2. Even though they have a CCJ against me; Would I be to request a settlement figure, or are they unlikey to agree to a lower larger payment
          3 (last one). When I take all my details for the questioning (bank statements, pay slips etc, do they take Copies of these and show IND or is it more of a case they "may" request to take a look at them when filling out a income & expenditure?

            Hello Nick,

            1. write and ask stating a freeze of the interest would allow you to reduce the balance.
            2. Yes again no harm in asking, answer I guess would be on the level of the offer.
            3. All depends if the claimant has requested sight of documents or if they are content
            to rely on the court officers findings.

              I am planning on offering £300pcm, this is a fairly large sum and much higher than the original loan monthly payments. The plan is infact to pay more than the £300pcm also as I want to clear it and get myself back on track. So would be great if they could freeze the interest.

              In your uys experience, should I OFFER £300, or see what they offer me and I just make higher payments when I can?

                An offer of settlement in the way you put forward needs to be realistic, affordable and sustainable og a prolonged period.

                How long would you have to pay £300 pcm to clear this debt?

                  It would take 3 years to effectively clear the debt if they freeze the interest.

                  Just over 2 if they removed IND's charges and reverted back to the original debt....

                    My personal opinion Nick: Offer £150 per month, put the others £150 a month in a safe savings account and then when you choose
                    make an offer in full and final settlement to bites of the cherry:rolleyes:

                      that sounds good! I will write to them tomorrow regarding the interest.

                      I assume the courts will put my offer of "£150" forward for me the day I visit & hopefully I get a swift answer. The sooner this is done the better!

                      Still just worried they don't base this on a basic wage 😕 So I want to be seen as reasonable as possible and offer a good amount; not something silly like £10 a month. I hope that go's into my favour should a judge get involved.

                        Yes Nick your willingness to pay the debt will be looked on favourably, so don't be encouraged to increase
                        the offer make it clear this is what you can afford but mention that you may be in the position to pay more in
                        the future.

                              Update for you all..

                              Spoke to IND on the phone today and went through a few bits with them,....Surprisingly helpful

                              They have Frozen the interest on the total amount. They will also make an amendment of £780 as I have a letter from welcome finance refunding due to errors they have made (annual statements not being sent)

                              She also explained that its nothing to worry about, they ultimately want a repayment plan that insures they get paid, so its not in there favour to demand anything over the top and the risk of not getting paid. She also advised its simply to fill in the From and there is nothing to suggest they need copies of bank accounts etc#


                              Last but not least, i explained that I'm on £15,000 basic a year and an "AOE" would mean the likelihood of me losing my job, She has noted the file and said as long as i stick to any agreed plan, it would be very unlikely they would go down that route.

                                Have you asked for this to be put in writing, If no do so asap.
                                You need to ensure that payments are made by standing order then only you can change the amount DD's ARE open to abuse!

                                Has Link stated that this " agreement " is not made under the terms of a consent (Tomlin) Order.
