          So looking at my CCJ letters.

          It turns out with a bit further digging, Am i right in saying that some Welcome Finance Agreements became "Un enforceable" if before April 2007?

          How would I find this out and am I possibly to late? is there any way of fighting how much I owe if i am to late?

            Yes Nick!

            So much manipulation of Welcome agreements/loans happened both before and after 2007, agreements were rewritten sometimes without the clients knowledge and many of these seem to have "vanished" when the branches were closed and the administrators required all the documents to be recovered.

            A CCA request and a SAR to Welcome would be worth doing I think.

              Well, Looking at everything that was supplied to me when i asked last year, the "Agreement" number is different on the agreement number I have on the original Hire Purchase Agreement.

              Letter Dated: 28 March 2007 from welcome finance
              Thanking me for choose them

              Hire Purchase Agreement: 2438080

              Then on the an Hire purchase statement that was supplied the number was 2454456 with a start date of 17 APRIL 2007

              Then looking at the "Claim form" the "Particulars of claim" state

              "Hire Purchase Agreement 2454456 arrears balance of £8300.44 as of 26/6/2009.


              Have I been issued a CCJ for a debt that they have no proof I owe? I have signed agreements for "2438080" signed by ME & Welcome Finance?

                You have been a victim of the welcome rewrite agreement con over a longer term

                Many borrowers were unaware this had been done without their consent

                Welcome employees earned fat bonus payments and was endemic within the organisation to manipulate the parent companies share price, Cattles

                That is what caused welcome to collapes and finished off cattles, delisted from the FTSE 250

                Is your signature on this other agreement, and i mean, is it actually your signature??

                  The only agreement my signature is on is the one signed dated by Welcome Finance on the 27/3/2007 - with agreement number 2438080 NOT the CCJ Agreement number of 2454456

                  Am i best going to a solicitor with this?

                  Once I am served, could a solicitor have this suspended to carry out further investigations?

                    Do you have a CCJ,
                    Have you been issued a claim
                    Have you been threatened with a claim??

                    If you have a CCJ you need to seek advice as this should have been challenged at the time. I know you were unaware but:

                      Yes I believe you have been caught in the Welcome Web of deception Nick.
                      This in my opinion is ample grounds to apply for setting aside the judgement,.

                        The CCJ was issued.

                        I have the original claim for last year. its not a new one, I just revisited all the old paper work and this stands out more and more! And upon looking online, it would seem these Welcome Finance Agreements are dodgy.

                        I assume I can set aside now the CCJ is issued and over a year old?

                          Set aside will be difficult but not impossible. That wil be down to the judge. The most it will cost you is £155.00

                          You and the court have been deceived.

                          You need to get all the evidence you can on the credibility of welcome finance and enclose it withn a witness statement with the set aside application.

                          The difficulty will be convincing a judge why this was not challenged at the original defence stage. You must state you have only just come accross new evidence. You must reference that new evidence

                            I think I will approach a Solicitor, I am happy to pay the £155 should I need to, but with regards to evidence, I would assume a solicitor will be able to put a stronger argument with regards to setting aside

                              Compile all the evidence before you see a solicitor.
                              Let him use that evidence
                              You be the dogs body for the solicitor
                              Without it it will be nothing but hearsay

                                Thanks I work in property so have a lot of links to solicitor firms; I will email him everything I have got an go from there.

                                if "Set Aside" How long does that last or is it permanent?
