I understand the judge decides, but this won't be with a judge? Will I get a further date once IND decide what they wish to do? Then sit with a judge & IND rep?

All assuming they reject my offer I have made?

Also, say I show spare funds of for "example" £200...£300, will he likely impose the full amount of spare of part, as the I & E is for fixed bills, nothing variable like food, broken car, dentist, clothing is it?

The court clerk passes everything up to the judge for him to go over the case notes and rubber stamp it. The clerk is just doing the donkey work.

You have to state a worst case scenario as to expenditure as to income. But do not take the preverbial

Interests rates might go up, you might lose your job. They have to be factored into any repayment settlement proposals

So as long as I am being reasonable with what I offer to pay, I should be ok with the payment plan. The attachment of earnings just worries me as you can understand. Also, with my pay varying, some months it will be good, but others, total basic, to I base the i&e on basic?

So, as you mentioned the Clerk is with me and te judge stamps it, is it all agreed in the room there & then?

Yes, you do the income and expenditure on your minimum basic salary after tax. No bonus, overtime, nothing

You will get a response anytime up to a week later if it is just a rubber stamp job. Depends when the judge reads the notes

Just say because of your employment you prefer to make payments via standing order rather than Attachment of earnings.

Tell them if you lose your job because of this AOE order if granted you will have even less to pay as a repayment schedule

Thank you so much. That's put my mind at rest. I wasn't aware it's done on my basic. That's honestly relieved me a lot. I will try and get that agreement up ASAP for you.

It is only done on basic salary as that is confirmed guaranteed income.

Bonus and overtime are not

Thank you. I will hopefully get this sorted, I have tried this "APS" 4 times already and no answer, I am going to print off the call log each day and send a letter at the end of the week to show I have been trying. It can only help should they fail to Serve me.

Is the APS depot near you?
Alternatively ask Ind for a copy to be provided and served.

It's a make believe "delivery"
Company I think, to make people call in order to be served. There is no address, no information at all, other than a number to call. The back of the card is blank.

IND said they can't, as its out for delivery! They however did give me the time day & location, so even if I'm not served, am I best just showing up. It can only show me in a better light, the fact I'm doing what I can?
