    Just a thought.

    How about a DPA 1998 s10 notice, with reference to s13 compensation.

    Nb. While awaiting the Supreme Court appeal Google v Vidal-Hall, as things stand I think that you can't claim for 'distress' alone, you must show quantifiable 'damage'.

      I have not got a clue as to why they are going down this route. I want to make arrangements to pay, but I am not going to pay a thing until it is defaulted and taken off my credit file. It's become difficult to move on with my life as I want to get a mortgage with my wife. We have 2 kids and have been renting for nearly 7 years now. I want to put that bit of my life behind me, I was literally on the streets and it was the worst experience I have ever had. Now I have my own business and things are going well but that chapter hovers over my head.

        I am yet to receive a response from Kensington. I know that they can not do much, but I contacted the CRA and they have contacted Kensington. Kensington have told them that they will not default the debt as they were the second charge on the property. Can anyone tell me what I need to do to take this matter to court?

                I employed a solicitor today, they are pretty sure that I would win, they also think that I should go for damages as well.

                      Hi guys,

                      More advice needed I am afraid. I employed Joanna Connolly, who I really like. She is trying to figure out how best to get damages, she sent my case to a panel who are reviewing it. The only issue I have is that it has been 2 weeks since I have spoken to her, when ever I phone I get a really nice chap on the phone who says that they have still not heard back and will contact me once any news comes in, i have also not had any information on how much they are going to charge. I have since spoken to 2 solicitors and have received 2 quotes but I still feel more comfortable using Joanna. One of the quotes came from stephensons, they seem fairly keen to take my case on.
                      Do you think I should wait for my current solicitor and is waiting more than 2 weeks the norm?

                        I just want to say that I have just spoken to Joanna and my concerns were wrong, I am so glad that I have chosen them. I think a lot was happening behind the scenes plus I didn't realise that I actually had not employed her and they were advising me (which most charge a lot for). It's a fairly scary process but I feel very confident in her and after speaking to Joanna today, I feel at ease. Let's just hope that Kensington do the right thing.

                          I thought I would give you guys an update. Kensington have finally agreed to take the entry off my credit file and I must say that it was down to Joanna Connolly, she stood firm with them after they kept on asking for extensions, while keeping me calm. Because of what Joanna has done for me, I can finally buy a house for my family, I also want to thank all the people on here, it's an excellent forum that has helped me.
