At the moment he can :ohwell: but he'd have to hurry, as the BR threshold will be increased to £5k from October: https://www.gov.uk/government/news/i...h-problem-debt

You can apply for a variation of the instalment order by submitting an N245 where you provide your financial details to back up your monthly offer: http://hmctsformfinder.justice.gov.u...s/n245-eng.pdf There's a £50 fee but you may qualify for fee remission, see here: http://hmctsformfinder.justice.gov.u...ex160a-eng.pdf :thumb:

Thanks for all your help guys... I really appreciate it.

If anyone can assist me in getting this case infront a judge again I would be most grateful. I obviously misunderstood or got things wrong and was ill prepared for the hearing.

        Hi All

So the claimant has given me a week from today to confirm a payment plan, he wants 500 a month which I cannot afford.

Do I need to wait for him to say no in writing or should I go ahead and get file an instalment order?

You can't pay what you can't afford, there's hardly any point in just saying no to him, it's best to fill in your financial details on the form above and make an offer you can afford, backed up by the figures on the form. That way he'll have no option, he can't expect blood to come out of a stone. :thumb:
