    About 4 years ago i joined a local gym.
    was there for a couple of years and then left, giving the required 3 months notice. At the end of last year i went back to the gym and filled in the DD form to start paying my membership again. At no time was i given, receive through the post, read at the time any terms and conditions of my membership.
    At the start of this year I injured myself so cancelled my DD. As i hadn't signed anything i thought no more of it. In January i got a letter from Harlands demanding money.
    I rang and spoke to an advisor. I told him that as i'd never signed anything I didn't think i was liable to pay anything. He told me I would have to go to the gym to confirm I didn't sign anything. I explained that if they wanted money from me then the onus was on them to prove that i had signed something and thereby prove my liability for the 3 months notice.
    i heard nothing more from them until today. 7 months later they are saying they were disappointed they hadn't heard from me and that i now owe £128-96 and if i don't pay they will hand my debt to a separate management company which may incur significant additional fees.
    Now i'm happy to ring them and give them a piece of my mind but wanted to do it 'officially'and ensure there is no comeback on me or lodging of an adverse note on my credit file!
    Please advise the best way to deal with these cowboys!

    Hi a common problem with gyms and cancelations!

    Make this a formal complaint about Harlands conduct in dealing with your initial complaint and the fact you had not signed any agreement/contract.

    The threat of a 3rd Party " management company " is regarding turning the account over to a debt collection agency, there's a couple of companies that specialise in gym debts, stroppy and full threats of the world coming to an if you don't pay.
    Anyway a Formal Complaint requires a company to fully investigate and respond to a complaint within 56 days.

    If you can find the name of the MD/CEO send the complaint to them.

          In writing by signed for post you need to keep a paper trail of the complaint.
