  • Transaction summary statement from Santander

    Hello,
    Wondering if anyone can help. I had a company bank account and the company went into liquidation. I had an overdraft on it but the bank couldn't enforce me to pay it back personally as they couldn't find the signed letters as me as a personal guarantor. They wrote to me saying they couldn't reclaim the overdraft. I never heard a thing after that. However three years on out of the blue I've had a statement showing the balance. I've called the number and reading between the lines it seems they've sold the debt on. Is it an automated statement or am I likely to hear from a debt collection agency? Help?!'

    Hi, Welcome to LB.
    Who is chasing you for the debt?
    Has the debt actually been sold or is the company
    acting on behalf of someone?

      Hey. I've just had a transaction summary statement from Santander showing the balance. It doesn't ask for anything First correspondence we've had from the bank for three years since they said we didn't have to pay back the overdraft. Reading on the internet people have then heard from third parties chasing the debt... I'm wondering if others have had similar?

        Did you save the letter from the bank saying they couldn't chase you for the debt?
        Debt is like any other trap, easy enough to get into, but hard enough to get out of.

        It doesn't matter where your journey begins, so long as you begin it...

          Hi,
          My guess is that Santander took over the accounts of the defunct company, and what you have received is an annual statement nothing more!

            and ... don't worry about DCAs yet they're all hot air most of the time You'll get lots of advice on here xx

              Thanks both. Nem - what do you mean took over the accounts of Santander? It was a Santander account. I'm just puzzled why the sudden correspondence.
              I think the letter was given to the liquidators so trying to get it out of archive!
              Yes won't worry about a dca yet. If they get in touch though is it best to ignore or communicate with them?

                If they do get in touch you could post on here and the knowledgeable Beagles will offer advice

                Never talk to DCAs over the phone if at all possible, keep written records :nod:

                    My apology I misread the first post, I thought that the account provider and gone bust in this situation debts are often transferred to another bank/provider.

                      If this was a company debt and the company was liquidated, they can't pursue you personally for the debt because it wasn't your debt, it was the company's, that's why they are limited companies, with limited liability.

                      Having said that, they could pursue you as a guarantor but obviously they'd need to show you'd signed a personal guarantee to start with, if they can't do that then they can't show there was a guarantor.

                      Have you got the liquidator's reports? They should include a list of all creditors. The liquidator should have dealt with all of them, that's what they are paid to do.

                      If they chase you for this debt all you need to say is that the debt was in the name of an insolvent company that's been dissolved and you are not liable for it. It wasn't yours.

                        Yes exactly. The company was liquidated three years ago. I can't remember if I signed a guarantee to be honest however when we discussed the overdraft at the time I asked them for a copy of the pg and they couldn't find it so they said I wouldn't have to pay it back. Never heard anything more. If I hear from a dca I will refer them to the liquidator. I spoke to the liquidators today actually and emailed them the letters. Will see what what say. Just don't want to be dealing with these dcas because I suspect they don't care about case details.... Thanks all. Funnily enough the account holders name on the letter was a weird mash of names.                           Sounds like a Santander "lash up" attempt at providing the required annual statement!

                          Have you checked your credit files recently for any activity in regard to this account?

                            Yes I suspect they are trying to mop up some funds. Yes nothing on my credit record at all.

                              It shouldn't be on your credit record if it was an account in the name of a company and not yours. Limited companies are separate entities from their director/shareholders/owners and there are separate company credit records. They didn't demand payment from you as a guarantor due to lack of documentation either, so there would have been no reason for a default to be recorded against you.
