Help with paypal debt please

I owe paypal (akinika debt now) £1500 that was done by a family member through my account, so can't argue it.

I've owed it for around 2 years now but about 1 and half years ago I fell out with my dad and have not had contact, he told akinika I didn't live there anymore and ive not heard anything ever since, nor has he.

Can anybody tell me if I leave this will it get wiped?

I want to contact them and sort a very small payment here and there but worried it may start it off again or worse again they say my debt has gone up! (But they've no address so cost of visits can't be added?)

No, debts don't get wiped, however, when there's a period of at least six years without payments or written acknowledgment, they do go statute barred, and are no longer recoverable through the courts.

From experience, not very far. They were chasing me for an alleged tax credits overpayment, they gave up the ghost over a year ago and haven't heard anymore.

Debt collectors who do not own the account (as opposed to debt purchasers who buy defaulted accounts) cannot take you to court.

They are not enforcement agents (bailiffs) so there is no question of adding the cost of visits. Home visits from debt collectors are often threatened but hardly ever carried out. The issue here isn't about visits but about the potential for court papers to be sent to an address you don't live at. If you are still able to collect your post from that address (or have it redirected via the PO) then you should be OK, otherwise Paypal or whoever buys the account could potentially issue a claim to the last address they had on record and when you fail to respond within 14 days, they can request default judgment, leaving you with a CCJ you knew nothing about. :scared:

Not many.

Yes, you can be taken to court for any debt, whether they will do so is another matter and anyone's guess.

Why would you be charged with fraud? If this went to court, it would be a money claim issued through the civil courts system (County Courts) which could result in a County Court Judgment (CCJ). It wouldn't be a criminal court (Magistrates Court) to be charged with a criminal offence. If it went to court you could set up a payment plan via a Tomlin order to avoid a CCJ on record. :thumb:

As long as you can keep an eye on the post, because if a claim is issued it has be acknowledged within 14 days. I'm not saying it will be issued, there are lots of us (myself included) who have debts and have never received a claim.

As above, it would be the same thing, if it went to court it would be to a County Court to obtain a CCJ (which can be avoided), not a Magistrates Court to be charged with an offence. Hope that explains it.

Ok so as long as I don't get a letter through previous address then I don't need need to worry?

If it does then I go to court and setup payment plan?

You need to be careful there, I wouldn't want to leave you or anyone else, with the wrong impression.

If you get a claim form and fill in the admission form and return it together with a repayment offer, they can request judgment which would leave you with a CCJ. :scared:

You'd need to make sure you settle it via a consent order that stays proceedings as long as you keep up the agreed repayments so that there's no CCJ on record even though you still have to pay it back. As we don't know whether they will ever issue a claim, I'll just leave it at that for now. If you do get a claim form through the post, do post up here before doing anything else. :typing:

Not quite. They can't just "slap you with a CCJ", that's not how it works. They would have to go to court first and you would have the opportunity to either defend or settle the claim and avoid a CCJ. In other words, one would have to follow the other, going to court is required before a CCJ can be obtained, however, even if they go to court the CCJ can still be avoided.
