  • Another lowell case... Grateful for any advice!

    Hello
    I was hoping to get some advice regarding a court case I am due to attend on Thursday.
    I received the notification to go to court in December and believed the debt was statue barred so I filed a defence believing that I had not paid any of the debt off since it had been passed to a debt collector however I have just received the paperwork from lowell ready for court on Thursday which includes the full account statement which shows I paid off some of it in 2009 and therefore it is definitely not statue barred.
    My problem is they sent me the account details back in Feb when I filed that I was defending, with no sign of this paperwork showing I had made some payments, so up until this court paperwork turned up I was so convinced it was statue barred.
    They have clearly done this so they can get all the additional costs from going to court,is there anything I can do and can anyone tell me what I am to expect on Thursday?

    Hi When you filed your defence Lowell Had 28 days to respond, are you saying that all that Lowell provided in support of their claim was statements? Nothing else has been disclosed in the way of documents? What type of account is this?
    You should receive all the documents that the claimant intends to rely on 14 days before the hearing so when exactly did these statements arrive?

      I received documents to support their claim on 23/04 which was just a copy of my final tmobile bill, which is where the debt originated from.

      On Saturday I received their witness statement ready for court on Thursday which now contains the evidence that I paid some of the debt in 2009...

      If they had sent that on the first statement of account I would have paid before court obviously...

      Does that make sense?

          Yes the initial proof they sent in april.

          Their witness statement has extra paperwork from their system showing the payments I made
