  • Defaulted account

    Was declared bankrupt in 2009 which has just cleared from my credit report....a £250 overdraft debt was missed off the bankruptcy and the account was'nt defaulted until 2011....this is now the only blip on my credit report....is there anyway I can get rid of it?

    If the account or OD existed at the time, then it is still a debt or liability that is covered by the bankruptcy, even if not included on the forms.

    382“Bankruptcy debt”, etc.

    (1) “Bankruptcy debt”, in relation to a bankrupt, means (subject to the next subsection) any of the following—

    (a) any debt or liability to which he is subject at the commencement of the bankruptcy,

    (b) any debt or liability to which he may become subject after the commencement of the bankruptcy (including after his discharge from bankruptcy) by reason of any obligation incurred before the commencement of the bankruptcy,
    So you can demand that they correct the default date to that of your bankruptcy date, which would result in it being removed from your report this year.
