  • LCS over Tax credit overpayment

    Hi please help..i am being harrassed by this company over tax credit overpayments from at least 6 years ago! Myself and my partner have been on a IVA for over 6 years and have just finished so any remaining debt was written off! I have spoken to Tax credits several times and they agree that we were on a iva and would sort it out but still getting letters and today a rude man rang my home number and refused to listen to what i was trying to tell him!! Please help as im worried that they will turn up on door and try to take stuff......

    If the tax credits overpayment was included in your IVA and they admit as much, yet they are still using debt collectors to pursue this debt, you should complain in writing. See here: https://www.gov.uk/tax-credits-appea...s/complaints#1

    I have been pursued by a number of DCAs for an alleged tax credits overpayment for three years. I sent the tax office a written complaint and asked for a statement or breakdown, also sent a copy to the DCA. The tax office took six months to respond and provided no statement, just said they were not going to write off the overpayment and unleashed another DCA. I've done pretty much the same with all of them and they've all gone away, not heard anything for nearly a year now. :grin:

    You don't have to speak to anyone over the telephone. If you happen to answer, just refuse to answer the security questions and hang up. Log all the calls you receive. :typing:

    LCS are just debt collectors, not bailiffs. They cannot take stuff. Although DCAs may sometimes threaten home visits, most are just empty threats. Even if they do turn up, you are under no obligation to speak to them.
