Once your defence is submitted, the court will send both sides directions questionnaires and notice of proposed allocation. Following that, the court will also give directions which will include the requirement to disclose the documents they intend to rely on for their claim. If it gets that far, and it looks like they have a good prospect of winning, you can always agree to settle via a Tomlin order, which has the effect of staying proceedings as long as you keep to the terms of the order. This would have the effect of avoiding a CCJ on record. :thumb:
