'Payments' Lowell Portfolio have come up with - can anyone help?

  • 'Payments' Lowell Portfolio have come up with - can anyone help?

    Hi

    I've just received documents from BCS/Lowell Portfolio, there are a lot of statements between 2000 and 2007, up to February 2007 then jumps to a statement for April 2012.

    They have then added a one page statement of 'payments' received, what is the U for after the 2011 payment please? (I will try and attach a copy).

    So the first payment showing in March 2007, and the statements ends February 2007.

    Also, there is no credit agreeent, just statements.

    Can anyone advise? Thanks

    U is most likely " Uncleared"

    Is this in response to CCA request?

      I don't think so, this is my copy of what they have submitted to the court.

      So if uncleared does that mean that wasn't a payment?

        They've sent a separate letter in response to the request for account info, basically saying that the documents for court is also covering my request. No signed credit agreement though and no proof of payments, they say they do not have this as they had already taken over the account by then? Yet they have enclosed statements for 2 years after taking it over anyway.

          Please give us some details of the claim.

          The original creditor.
          The type of account.
          The default date.
          if appropriate have you sent a CCA request?

            Store card
            Default 17 May 2005

            I sent a CCA request under CPR if that's right?

            Judgement was made against me January 6th.
            Set aside April 16th.

              Ahh, I see the error Zoe CPR 31.14 is for all the documents mentioned in the particulars of claim (POC)


              A CCA request is made under sections 77/78 of the Consumer Credit Act 1974 (as amended).

              A £1 statutory fee is payable ( use a cheque or postal order endorsed "for statutory fee only" .

              Now you have me slightly confused, a judgement was set aside? On what grounds?
              Are you now attempting to defend the original claim?

                Oh I've got confused with the different requests then and too late to change it now.

                I did email Creation though and they advised me the account is purged due to more than 6 years having passed so said they no longer have any information.

                The judgement was set aside on the grounds that it may be statue barred (it is) and it all falls on the mystery payment in 2011 basically.

                I'm not sure if I have done things right, I am attempting a statute barred defence.

                      That's a puzzle then, but if Lowell intends to rely on that statement the " U " must be explained.

                      I suggest and e-mail or letter addresses the Chief Operating Officer Andrew Bartle requiring an explanation from him.

                      When a " creditor " supplies" internal data such as this it is supposed to supply an easily understood " key" to phrases and abbreviations used in the documents.

                        I have sent an email to a couple of generic lowell emails that I found, marked FAO. Will see if I get a reply.

                        I'm not feeling hopeful about going to court now.

                            Not only do the Leeds Losers have to PROVE that a payment was made but the MUST PROVE the payment was made by YOU or someone acting on your authority. Bet they cannot
