  • Time barred debt - advice required

    I took out a Citifinancial loan dated October 2004. Last payment was made in 2008 although DCA claims that they received third party payments in 2009. I requested evidence but never received a reply.

    Now received Northampton County court claim submitted by claimant Restons solicitors. I have acknowledged online and need to submit my defence.

    I have sent CPR31.14 letter to Restons requesting items mentioned on the claim, contract and assignment notice plus inspection of any documents they will be using. Received letter from Restons stating they are not obligated to provide any documents to support their claim. I can provide exact wording if needed.

    What wording should I use when I file my defence? Should I reference that Restons have not provided documentation requested? Should I reply to Restons, if yes what points do I need to highlight.

    Any help is greatly appreciated.
