  • What is the difference between the FOS and the FCA Please?

    I currently have serious complaints in with the FOS against my bank, I also have an ongoing Court case with the Bank, I have asked the bank to stay proceedings until the FOS investigation is completed as I understand the FOS will rarely take on a complaint if it has already been through Court and I believe it is my right to have the FOS investigate my complaints before I enter into the considerable costs of a Court case. Is it worth while complaining to the FCA also or are they one and the same thing?

    Please can anyone advise me?

    I haven't read any of your previous threads on the topic so unless you give more information on the first post in a new thread then there is no chance of getting advice unless you want me to read through all your other threads that may or may not have any relevance to the question. Personally, I'm not going to but could this have been asked on another one of your active threads?

      Thank you leclerc, I was going to put this on my last posting which has the details, but noone has answered the questions on there so thought I`d start a new thread, I`m really sorry and will remove my question when I got onto my main computer.

        FOS = Ombudsman Service investigates complaints on financial matters and has a degree of " mediation" remit.
        The FOS is empowered as a " regulatory body".
        FCA, Financial Conduct Authority Regulates and licences Consumer Credit
        Licenced companies.
        FCA will log contacts from individuals making complaints regarding the conduct of a
        finance providers and the debt collection " industry", the details of such complaints will
        be logged and referred to when CCL's are applied for and renewed.
        The FCA in the same way as the OFT does not respond directly to the complainant
        on the action that may or has been taken.

        As to your first question on this thread, it would be better to use your original thread if you want further advice.

        Meanwhile perhaps a read of BCOBS may assist you.

              My experience with this in the FOS being the way to go in disputes with your bank is the right way, however the FOS become weak on matters of contract which is where you may have cause to bring the matters to the FCA if only to answer any questions you may have.
