7 year old CCJ now received a "Charge for payment of money"

  • 7 year old CCJ now received a "Charge for payment of money"

    I had a CCJ raised against me in 2008 for £4000 which has never been enforced. I argued against this debt prior to it reaching the CCJ stage as i did not agree with what they were charging me. I did not have any communication with them for some time and also started working/living abroad and I did not return to the country until 2013. My credit file is clean with no outstanding debts.

    I have now been hand delivered a Charge for payment of money referring to this CCJ and some additional charges. The address on the court documents is incorrect and they did not supply me with a DAIB. The document states that i have 14 days to pay the outstanding amount.

    Can someone advise if this CCJ/Charge for Payment is legally enforceable and what my options are if any?

    Are you resident in Scotland?

    A Charge for payment on money is a Formal Demand for payment after a decree.

      Hi, yes i am resident in Scotland, so i have no grounds to defend it or argue the amount? what about negotiating payment terms?

        Hi, I am not an expert in Scottish Law as far as I know a " Charge" has similar effect to a Statutory Demand for Payment in Civil Law in England & Wales i.e. the first step to proving insolvency prior to a petition for Bankruptcy.

        I am unsure if there is any time limit to the use of Charge after a decree, my personal feeling is that you
        need to seeks local legal advice, given the complexities of Scottish Civil Law.

        I will see if I can prompt a response from someone more knowledgeable that I on this subject.
