  • CCJ against me but I do not know what for

    Hello

I am looking for some advice please.

After checking my credit file I have found that a CCJ has been recorded against me in January 2015

I am not 100% sure but I think it may relate to an old loan I had with LLoyds and which I put into dispute back in 2010 although I think I may have made payments up until some time in 2012

I do recall being passed from DC to DC and each time I told them that LLoyds had not provided the DPA info I requested and in time I stopped receiving any letters.

Now this CCJ has emerged and it is in my maiden name (been married 18 months now ) and I have not received any paperwork / court papers or details of the judgement as I moved house last year

I am conscious that this was awarded nearly 3 months ago & I am now concerned that the bailiffs might appear. My credit file has recently been updated with my new address although if I have not received any paperwork then I wonder where it is being sent to.

I really want to get this sorted out

Could anyone advise me what to do now............Should I apply to the court for this to be set aside ?

    Thank you in advance

      Hi welcome to LB

      Clarification Please:
      1. You say " Lloyds had not provide the DPA information" Was the a Subject Access Request or are you referring to a CCA request i.e for a copy of the agreement?
      2. It is the responsibility of a debtor (account holder) to inform creditors of an address change, and documents including a Claim Pack can be sent to the " last known address", and as has happened to you a " judgement by default" has been made, was the bank informed?
      3. What is the name of the claimant on the judgement?

Set aside; Fee Payable £155.00: You will have to show that you have a defence which has a " reasonable" chance of success as well as the non receipt of the claim.
