  • 2nd post-trying to get straight CCJ- ARGOS - 2010

    Hi all

    briefly here goes...

    my bf got a argos store card 2007, never paid it of in went to court in 2010 where a CCJ was put on his credit file (only just got the credit file and seen it was put on) i called the court who give me solicitors (brian carter) number, i then called them- they passed it back to argos in 2012 an told me they cant help, what do i do next? just want to get straight after messing things up when younger. ccj is on there an really don't know what to do? like my last post im not legally minded at all so please bare with me

        I'm sorry to say that at this stage there is little I can suggest, if a judgement in default in entered in favour of claimant it is because the " defendant " has not acknowledged service of the claim and has not filed a defence.

        If the defendant wants to challenge the judgement he has to apply for it to be set aside within a very short time in this case with judgement 5 years later it just will not happen.

        The good news is that the CCJ will be remove on the 6th anniversary of the judgement date.

        Has no one contacted him about this in the last 5 years.?
        Is the credit file entry in Argos' name ?

          We believe the last contact was in 2012 when solisters handed it bk , cut long storey short - living with parents was a falling out an never got any letters etc an got in bit of a hole !! We know the ccj is on there for 6 yrs but don't know where to go , I'll try to get through to Argos but got a feeling there going to say it's out there hands - Argos is not on there it's just got court date - amount etc

          we we trying to get straight this all happend 7-8 yrs ago an now want to buy a home so getting all straightend out -we have deposit etc but with ccj prob not going to help

            A county court judgement supercedes the original agreement.
            After the time elapsed Argos if they were the claimants may well
            attempt to enforce the judgement so you are far better leaving
            this as it is.

            What you are seeing is the " public record" of the judgement.


            For information: Mortgage providers will look at least three years good/excellent credit management some a lot more.

            You will have to have steady work records over at least 3 years, you will be asked about defaults and CCJ's in the past 5-6 years.

            Electoral Roll entitlement for at least 3 years.

            Sorry I know this in not what you want to hear, but you must (both of you) build a viable credit profile. Making a mortgage applications that is unlikely to succeed will make life more difficult as credit searches leave an foot print on credit files which will be seen by prospective lenders.

              So leave it rather then getting an s put against it?

              Mine is all good an been building my credit up , it my bf where we are going to struggle with what with this and the Santander thing thank god those are the only 2 things ! The other issue is the elec role , I'm on there but haven't put him on yet due to being scared if beliefs turn up ��

                Yes the "S" is of little help it's the fact a CCJ was awarded that matters.
                Leave the sleeping dog!!

                He will have to be on the ER when a mortgage app is made and be able to show stable address data for 3 years.
