Can you go bankrupt to stop bailiffs taking further action to seize your property?

    Can you go bankrupt -- or get a debt relief order -- to stop bailiffs taking further action to seize your property?

    Could you go bankrupt if you have too many fixed penalties for trafficking violations; or is such a category of debt exempt from bankruptcy proceedings?

    Under what circumstances would they refuse your application to go bankruput? But if your application to go bankrupt is refused could you still get a refund, given that it will cost several hundred pounds to file for bankruptcy?

    It's not so much that they will refuse your application, that's more likely to happen with a DRO than with bankruptcy due to the stringent criteria to qualify for a DRO. What you should bear in mind is that certain types of debts cannot be included in either DROs or bankruptcy. Parking penalty charges from the local authority can usually be included but not magistrates fines.

    There are other ways to stop bailiff action though, without having to resort to personal insolvency. It would help if you gave us a bit more details about your issues involving bailiffs. :typing:

      Agree with Flaming Parrot that there are other ways to stop bailiff action without resorting to this or applying for a DRO

      The current fees (Mar 2015) are:
      • £525 for managing your bankruptcy application
      • £180 for court costs (you may not have to pay this if you’re on income support)


      Regardless, I suggest that you think long and hard of the long term consequences of you going bankrupt when easier less impacting solutions can be found here on this forum.
