    The CCA is a section 78 request Loan sect.77
    Template in forum library.

      Last question. Should i use the longer or shorter version of the cca template. Also can the same template be used for sainsbury loan and halifax credit card?

        Use the longer one ok for all requests £1 stat fee for each one.

            CCA request not necessary to sign, but I see no problem with doing so,
            the talk of signature lifting is really a myth I have never seen any proof
            of this.
            CPR certainly sign.

              Could it be possible that the debt is not statute barred. Would the default start when i started making monthly payments and go on credit file then which was over 7 years ago ? Hence coming off my file 6 years after that period
              I stopped making payment around 6 years ago can't remember when.

                So I got a response from Marlin to the CCA i sent in

                They said:

                We confirm that we do not hold all your information on file, therefore we have requested a statement of account and copy of agreement from the original creditor which we will forward to you upon receipt. Your account is on hold while we await this information.

                  The account would have been defaulted after 2-3 missed payments.
                  The clock starts ticking on the date contractual payment was due and
                  not made. after which no further payment and unequivocal written
                  admission of liability has been made.

                    Be very careful when dealing with Marlin ( Cabot's attack dogs ) they will lull you into thinking you have breathing space and then suddenly up pops a Northampton CCBC claim for a CCJ from Reston solicitors. If you receive one, LOOK at the paper work very carefully indeed. I didn't, panicked and caved in to the tune of £900+ Only to realise much too late, no wet ink signature on the claim form, obscure wording such as on or about etc. By the way if you submit a defence to NCCBC keep it simple stupid Northampton is full of worker drones without a ounce of legal training!

                          You don't have to do anything, they are in default of your request. :thumb: If someone contacts you again about this account, do post up here and you can then refer them to their failure to respond to your CCA request. :typing:
